🏡 When disaster strikes your HOA community, who pays for the damage—and who gets to decide?

A hurricane damages a common-area roof. A water line breaks. A fallen tree damages property. Suddenly, your HOA board is facing urgent decisions about repairs, insurance coverage, and potentially thousands of dollars in unexpected expenses.

But just because the HOA maintains something doesn't necessarily mean it's responsible for insuring it—or paying for the damage.

Before committing association funds, approving repairs, or telling homeowners who is responsible, board members need to understand what their governing documents and insurance policies actually require.

📖 Check out our newest blog post: "Florida HOA Insurance Claims After Property Damage: Who Decides, Who Pays, and What Boards Should Document."

We break down some of the most important steps HOA boards should take following property damage, including how to protect insurance claims, document emergency decisions, and avoid costly disputes over deductibles and assessments.

At Southern Atlantic Law Group, we help Florida homeowners' associations navigate complex legal issues, protect association interests, and make informed decisions when challenges arise.

A major property-loss event can force a Florida HOA board to make consequential decisions within hours—or even minutes. A storm damages a common-area roof. A water line fails. A drainage problem affects multiple parcels. A fire, vehicle impact, plumbing leak, or fallen tree creates immediate press...

Sometimes, the need for guardianship doesn’t happen all at once.

It may start with unpaid bills, unusual financial activity, unsafe living conditions, difficulty making medical decisions, or concerns that a parent can no longer safely manage important personal or financial matters. ❤️

Eventually, families may ask: “Do we need a guardianship?”

The answer depends on the circumstances.

Florida law requires courts to consider whether less-restrictive alternatives, such as a durable power of attorney, trust, or health-care directive, can meet the person’s needs. When those options aren’t available or aren’t enough, guardianship may become necessary. ⚖️

Some signs it may be time to speak with an attorney include:

• Bills repeatedly going unpaid
• Concerns about financial exploitation
• Unsafe decisions or living conditions
• Difficulty making important health-care decisions
• Family disagreements about who has authority to act
• Existing legal documents that no longer provide what is needed

A diagnosis alone does not determine legal capacity, and guardianship isn’t necessarily all-or-nothing. Florida law allows for both limited and plenary guardianships, depending on the circumstances. 📋

If you’re concerned about a loved one’s ability to safely manage important decisions, early legal guidance can help your family understand its options.

🏡 You’ve decided who should inherit your home. But will your estate plan actually make that happen?

In Florida, a will or trust may not have the final say. Homestead rules can affect who receives the family home—and leave a surviving spouse and children sharing ownership in ways no one intended.

Our new blog explains why your deed, estate plan, and family circumstances need to work together, along with common mistakes homeowners should avoid.

Read “Florida Homestead and Estate Planning: Why Your Will or Trust May Not Control the Family Home” here: https://southernatlanticlaw.com/florida-homestead-and-estate-planning-why-your-will-or-trust-may-not-control-the-family-home/

Have questions about how your home fits into your estate plan? Contact Southern Atlantic Law Group at (863) 656-6672.

For many Florida families, the home is the most valuable asset in the estate—and the one most likely to cause confusion after a death. A homeowner may assume that a will, trust, or deed settles the question of who receives the property. In Florida, that assumption can create serious problems. Flor...

For HOA boards, adopting the annual budget is about more than numbers. Decisions made during the process can lead to assessment disputes, records requests, owner challenges, or questions about compliance with Florida law.

Before approving the 2027 budget, boards should consider:

⚖️ 1. Are assessments authorized and allocated correctly?
The declaration, bylaws, and governing documents may dictate how expenses are allocated among owners.

💰 2. Are reserves being handled properly?
Florida law has specific requirements regarding reserve calculations, funding, use, and any reduction or waiver.

📋 3. Is the adoption process compliant?
Proper notices, agendas, and meeting procedures are just as important as the budget itself.

🤝 4. Do major contracts require competitive bids or legal review?
Florida law generally requires competitive bids for certain contracts exceeding 10% of the association’s total annual budget, including reserves, subject to statutory exceptions.

📁 5. Is the board prepared for what comes next?
Consider potential collections, records requests, covenant enforcement, vendor issues, and other disputes before they arise.

The best time to address these issues is before the board votes—not after a dispute develops.

Before finalizing your 2027 budget, consider having association counsel review the process, governing documents, and proposed actions.

Southern Atlantic Law Group advises Florida HOA boards on governance, compliance, collections, contracts, covenant enforcement, and dispute prevention.

🏢 You spent years building your business. But have you planned for what happens when you’re no longer the one running it?

For family-owned businesses, succession planning can be especially complicated. It’s not simply about deciding who gets the business. It’s about creating a clear roadmap for what happens next. 👨‍👩‍👧‍👦

A strong succession plan should address:
🔹 Who will own the business
🔹 Who will manage and make decisions
🔹 How ownership interests will be valued and transferred
🔹 What happens if an owner dies, becomes disabled, retires, or wants to leave
🔹 How a buyout will be funded
🔹 How the business plan works alongside each owner’s estate plan
🔹 Whether the next generation actually wants—and is prepared—to take over

Without a plan, important decisions may have to be made in the middle of a crisis, when emotions are high and family members may have very different ideas about the future.
And succession planning isn’t just for business owners who are ready to retire. In fact, the best time to make a plan is often long before you think you’ll need one. ⏳

If your family business doesn’t have a succession plan—or if yours hasn’t been reviewed in years—the attorneys at Southern Atlantic Law Group can help you evaluate where things stand and put the appropriate documents in place.
Protect the business you worked so hard to build. ❤️
