... and so it begins with the new Legislative session in Tallahassee.
House Bill 837 has been introduced to do one or more of the following:
Destroy the attorney-client communication privilege which "is the oldest privilege recognized by Anglo-American jurisprudence" and dates back to the Roman Republic, and which the Florida Supreme Court has upheld since Florida has been a state in these United States;
Permitting insurance companies to act in "bad faith" with no real consequences, even when they refuse, "in good faith to settle claims when, under the circumstances, they could and should have done so, had they acted fairly and honestly toward their insured with due regard to the insured's interests and NOT the insurance company's interest," AND taking away YOUR ability as an insured to sue YOUR insurance company in the courts, i.e., forcing YOU to go to arbitration, which always works in favor of the insurance industry
Taking away the ability for an injured person to receive medical care if they do not have health insurance to pay fore medical care, which is especially true when an injured person goes to the local hospital emergency room where all of their Personal Injury Protection (PIP) benefits are used up by the ER staff who then send people home with no real help for their injuries, or
Limiting and restricting YOUR ability to recover YOUR medical expenses incurred through no fault of YOUR own and which were the result of someone else's negligence by limiting YOUR recovery to the Medicare reimbursement rate (which very few doctors who treat injured persons even accept);
And last BUT NOT LEAST, destroying the concept of comparative fault which has been the law in Florida since 1973; and replacing it with a system in which those who may have contributed to their own injuries will lose the chance to recover with a system known as contributory negligence - which only 4 states still use today and most states have replaced since the 1970's.
IN SHORT, your rights as a consumer in Florida are UNDER ATTACK by the insurance industry and large corporations which control Florida's Governor and Republican Legislature.
IT IS TIME TO FIGHT BACK AGAINST THIS OBSCENE ATTACK ON OUR RIGHTS BY OUR ELECTED OFFICIALS WHO DO THE BIDDING OF THE INSURANCE INDUSTRY AND BIG CORPORATIONS and could care less about the rest of us !
