If the Tort Deform Bill passes, where is the language in the bill that the insurance companies will bring down the insurance rates? I spoke with a friend last evening who, luckily has paid his mortgage off, but is now "bare" in that he can no longer afford his homeowner's insurance coverage so he is, in essence, self-insured if a storm hits again. The carrier advised him that his roof was too old to insure and dropped him as an insured like a hot potato. Gotta love our politicians. NOT !

House Bill 837 has been introduced to do one or more of the following:

Destroy the attorney-client communication privilege which "is the oldest privilege recognized by Anglo-American jurisprudence" and dates back to the Roman Republic, and which the Florida Supreme Court has upheld since Florida has been a state in these United States;

Permitting insurance companies to act in "bad faith" with no real consequences, even when they refuse, "in good faith to settle claims when, under the circumstances, they could and should have done so, had they acted fairly and honestly toward their insured with due regard to the insured's interests and NOT the insurance company's interest," AND taking away YOUR ability as an insured to sue YOUR insurance company in the courts, i.e., forcing YOU to go to arbitration, which always works in favor of the insurance industry

Taking away the ability for an injured person to receive medical care if they do not have health insurance to pay fore medical care, which is especially true when an injured person goes to the local hospital emergency room where all of their Personal Injury Protection (PIP) benefits are used up by the ER staff who then send people home with no real help for their injuries, or

Limiting and restricting YOUR ability to recover YOUR medical expenses incurred through no fault of YOUR own and which were the result of someone else's negligence by limiting YOUR recovery to the Medicare reimbursement rate (which very few doctors who treat injured persons even accept);

And last BUT NOT LEAST, destroying the concept of comparative fault which has been the law in Florida since 1973; and replacing it with a system in which those who may have contributed to their own injuries will lose the chance to recover with a system known as contributory negligence - which only 4 states still use today and most states have replaced since the 1970's.

IN SHORT, your rights as a consumer in Florida are UNDER ATTACK by the insurance industry and large corporations which control Florida's Governor and Republican Legislature.

What is the Florida Impact Rule and Exceptions to the Rule?

The state of Florida follows what is known as the "impact rule" which states that recovery for mental and emotional pain and suffering is not allowed unless a plaintiff has experienced physical contact in the course of the emotional distress being created. The basis is to have physical evidence tied to emotional distress to prevent false claims. Without physical evidence, someone could complain they have been traumatized emotionally without any physical evidence of harm.

The Florida Courts have however established some exceptions to the rule. For example, if someone were to witness a close family member being seriously injured such as seeing a loved one struck by a car in a pedestrian crosswalk, even though they themselves were not physically injured. “If they had just paid, as the estimates showed in the first place, there wouldn’t be all these other problems,” Imagine that. An insurance company simply paying on a claim without fabricating or altering an inspection report. If an attorney were to "Alter" a document and then present it to the Court, they would likely be disbarred. If someone filed a false police report, they might be charged with a crime. But when an insurance adjuster alters an independent adjuster's report - and one who has actually gone out to see the property, as opposed to the "desk adjuster" - for no reason other than to reduce the amount of the claim to be paid by the insurance company, nothing comes of it. Maybe our State Attorney General should prosecute those adjusters, but likely this will never happen ....
