PAYMENT RIGHTS FOR VICTIM OF A HIT & RUN CAR ACCIDENT

If a driver causes your accident and then flees the scene, injured crash victims can still collect by pursuing a personal injury case. Injury claims against the hit & run driver are covered by multiple Uninsured Motorist (UM) policies including insurance coverage:

● for vehicle that was struck by the hit & run driver
● on the victim’s own auto policy if it’s different than the policy on the involved vehicle
● all other policies for all people who live with the victim on the crash date who are related to the victim by blood or marriage

Add the per-person UM bodily injury coverage limits on every applicable policy to determine the total amount of coverage available to fund injury claims.

There must be contact between the hit & run vehicle before UM coverage applies. If there is no contact between the vehicles, there is no coverage for injury claims. Also, in a hit & run collision, there is no UM coverage for the damaged vehicle. You must have collision coverage to collect for car damage in a hit & run accident.

Even though you present claims against your own insurance carrier, the UM insurer will be representing the hit & run driver, and the insurance adjuster will make every effort to minimize injury claims or deny the claims outright. In fact, if the case cannot be settled and suit is filed, the UM insurer will hire a lawyer to defend the hit & run driver in court. Hit & run crash victims should not trust the claims adjuster to simply offer fair value for injury claims.

A person injured by a hit & run driver is entitled to full payment for all past and future medical medical bills, payment for lost wages and lost future earning ability, payment for scarring or disfigurement, payment for other financial loss arising from the hit & run accident, and cash payment for all crash-related pain and suffering. Money collected through the personal injury case is tax-free.
