If you were unable to speak for yourself during a medical emergency, would your family know what kind of care you would want?

An advance directive allows you to put those wishes in writing before a crisis occurs. It can provide guidance about resuscitation, life-sustaining treatment, and other medical care if you become temporarily or permanently unable to communicate.

It is also important to understand that an advance directive and a medical power of attorney serve different purposes. One documents the care you want. The other names someone you trust to make health-care decisions for you.

A complete estate plan should prepare for what happens during your lifetime, not only what happens after you pass away.

Today is National Dog Day, a day to celebrate the loyal companions who are always there for us.

But have you made a plan for who will be there for them if you become ill, incapacitated, or pass away?

Your estate plan can include instructions for your pet’s care, identify a trusted caregiver, and help provide the financial resources needed to support them. Because they are family, too.

Contact Meuli Law to discuss including your pets in your estate plan.

Your family loves each other. Everyone gets along, and there is absolutely no reason they would ever argue over your health care.

Really, what is the worst that could happen?

If you become unable to make medical decisions and have not appointed a health care agent, the people closest to you may be left trying to agree on who should speak for you.

But what happens when everyone believes they know what is best?

In Colorado, if an agreement cannot be reached, the conflict may lead to a guardianship proceeding. All while your family is already facing a medical crisis.

A Medical Durable Power of Attorney allows you to decide who you trust to make medical decisions when you cannot speak for yourself.

Would your family know exactly who should speak for you?

What happens to your debts when you pass away? Do those debts go away? Does it matter how your assets are structured? Does the type of debt make a difference?

In Colorado, creditors may have the right to make claims against an estate, which can impact how and when assets are distributed.

Understanding how creditor claims are handled can help you plan ahead, protect your estate, and reduce potential complications for your loved ones.

Estate planning is not just about deciding who receives your assets. It is also about understanding the factors that could affect what is ultimately passed on.

We tend to think families only argue over houses, money, or large inheritances.

But after a death, disagreements can begin over family photos, jewelry, furniture, or even a state quarter collection.

Grief can bring out both the best and the worst in people. Items that seem small today may hold deep emotional meaning later, especially when no one knows what their loved one truly wanted.

A thoughtfully prepared will or trust can provide clearer direction for your assets and personal belongings, helping reduce uncertainty and potential conflict among the people you leave behind.

Does your current estate plan clearly explain your wishes?

August is National Make-A-Will Month, which makes it a good time to finally move this one out of the “we have plenty of time” folder.

Estate planning is easy to put off. There is always something more urgent, another bill, another appointment, another project, another reason to say, “We’ll take care of it later.”

But putting your wishes in writing is one of those things that can make life much easier for the people you love.

Who should receive your property? Who should handle your affairs? Who do you want making decisions if you cannot?

You probably already have opinions about those things. A will helps make those wishes official.

If creating or updating your will has been sitting on your someday list, August might be a good month to finally check it off.
