When you are raising a child with special needs, estate planning is about more than deciding who receives what.

It is about creating a long-term plan that protects your child, preserves important benefits, and gives future caregivers the guidance they need.

A Special Needs Trust can be a powerful foundation, but families should also think beyond the legal documents. Your child’s routines, care needs, preferences, and daily life matter too.

At Estate & Elder Law Services, we help families build plans that support their loved ones today, tomorrow, and for years to come. www.eaels.com

Older Americans Month: Protecting the Future With Estate Planning

Older Americans Month is a time to recognize the strength, wisdom, and contributions of older adults in our communities. It is also an important reminder to plan ahead and make sure your wishes, your health care decisions, and your legacy are protected.

Estate planning is not just about distributing assets. It is about having the right legal tools in place to protect yourself and your loved ones as life changes. A thoughtful estate plan can help ensure your finances are managed properly, your medical wishes are honored, and your family has clear guidance when they need it most.

For older adults, estate planning may include a will, trust, powers of attorney, health care directives, long-term care planning, and strategies to help protect assets. These tools can provide peace of mind and help avoid unnecessary stress for your family in the future.

This Older Americans Month, take time to think about the future and whether your plan reflects your current needs and goals.

At Estate & Elder Law Services, we are here to help you create a plan that protects what matters most.

Because planning ahead is one of the greatest gifts you can give your family.. www.eaels.com

Land of the Free, Because of the Brave.

This Memorial Day, we pause to honor and remember the courageous men and women who gave their lives in service to our country. Their sacrifice made our freedoms possible, and their legacy will never be forgotten.

Today, we remember the brave. We honor the fallen. And we give thanks for the freedom we enjoy because of them.

Mental Health Awareness Month: Planning With Compassion and Protection

Mental Health Awareness Month is an important reminder that planning for the future is not just about assets. It is about people, dignity, care, and peace of mind.

For families who have a loved one living with mental health challenges, special needs planning and estate planning can provide critical protection. The right plan can help ensure that your loved one has access to support while preserving eligibility for important benefits such as Medicaid or SSI.

A thoughtful estate plan may include a special needs trust, powers of attorney, advance health care directives, guardianship planning when appropriate, and clear instructions for future care. These tools can help reduce confusion, prevent crisis-driven decisions, and make sure your loved one is supported in a way that respects their needs and independence.

Mental health can affect individuals and families in deeply personal ways. Planning ahead is one of the most meaningful steps you can take to protect your loved one’s future.

What Is a Certified Elder Law Attorney?

A Certified Elder Law Attorney, or CELA, is an attorney who has met rigorous standards in elder law, including experience, continuing education, and demonstrated knowledge in areas that affect older adults, individuals with disabilities, and their families.

Elder law is about more than legal documents. It includes planning for long-term care, Medicaid, asset protection, guardianship, special needs planning, and helping families make informed decisions during important life transitions.

At Estate & Elder Law Services, we are proud that both Catherine B. Read and William W. Erhart are Certified Elder Law Attorneys.

This certification reflects a commitment to helping clients navigate complex legal and care-related issues with knowledge, compassion, and confidence.

Whether you are planning for your own future, supporting an aging loved one, or creating a plan for a family member with special needs, working with a Certified Elder Law Attorney can provide peace of mind. https://zurl.co/v0UCQ

**Protecting an Inheritance from Poor Financial Decisions**

Leaving something behind for the people you love is a meaningful act. But what happens when someone you care about struggles with money, addiction, debt, or outside influence?

An inheritance should provide stability, not create stress.

With proper estate planning, you can leave support in a way that protects both your loved one and your legacy. A trust can help you set clear guidelines for how and when assets are distributed. Instead of giving someone a lump sum all at once, you may choose staggered distributions over time or limit funds to specific needs like housing, education, medical care, or basic living expenses.

You can also name a responsible trustee to manage the inheritance and make decisions based on the instructions you leave behind. This person acts as a safeguard, helping ensure the money is used as intended.

For beneficiaries who need extra structure, an incentive trust may provide support while encouraging positive choices, such as maintaining employment, completing treatment, or avoiding harmful financial behavior.

This kind of planning is not about punishment. It is about protection.

At Estate & Elder Law Services, we help families create estate plans that reflect real-life concerns, family dynamics, and long-term goals. With the right plan in place, your legacy can provide care, security, and peace of mind for the people who matter most. www.eaels.com

Foster Care Day is a meaningful reminder that family can be built in many different ways.

For foster parents, kinship caregivers, and families who open their homes and hearts to children in need, the bond can be life-changing. But when it comes to estate planning, the law may not always recognize those relationships automatically.

A foster child may not have the same inheritance rights as a biological or legally adopted child unless they are specifically included in your estate plan. That is why having the right documents in place can make such a difference.

A will, trust, guardianship plan, or beneficiary update can help ensure the children you love are protected, provided for, and remembered according to your wishes.

At Estate & Elder Law Services, we help families plan for the people who matter most.

This Foster Care Day, take a moment to honor the love, stability, and care foster families provide, and make sure your planning reflects the family in your heart.

Estate & Elder Law Services was honored to be part of the Walk for Autism on April 18th at Dover Motor Speedway. For 20 years, this incredible event has brought Delaware’s autism community together, raising vital funds to support families and increase awareness across the state.

We were proud to have Kylee, Bill, members of our team, and their families join us in walking for such a meaningful cause. Seeing so many people come together in support, compassion, and community was truly inspiring.

Thank you to everyone who participated and helped make the day so special. We are grateful to stand alongside families, advocates, and organizations working to make a difference for individuals with autism across Delaware.
