A sada vidimo konkretne rezultate!

IMPORTANT UPDATE: OUR T VISA LITIGATION IS MAKING A DIFFERENCE!

We are seeing exciting results from our litigation in the Wendy et al. lawsuit, and we want to share this important update with our clients and community.

Thanks to this litigation, members of our lawsuit who filed T visa applications before August 28, 2024, and are still awaiting decisions now have an opportunity to receive a Bona Fide Determination (BFD).

Why did we file this lawsuit?

USCIS created a regulation that allowed newer T visa applicants to be considered for a BFD but excluded those who had already filed before August 28, 2024.

We believed this was unlawful and unfair. Under the leadership of litigator Jesse Bless, we challenged that regulation in federal court.

The judge essentially struck down the portion of the regulation that excluded older applicants from BFD consideration.

Our litigation group includes T visa applicants across the United States, and the court's ruling applies to members of our group regardless of where they live.

We also believe this case is having an impact beyond our own clients. The court's decision provides legal authority that other attorneys and applicants who were not part of our lawsuit may be able to use when advocating with USCIS for BFD consideration.

And now we are seeing results!

Over the past two weeks, our office has received an avalanche of BFD notifications from USCIS!

Many are positive BFD decisions, which is wonderful news for clients who have been waiting so long.

Some are negative BFD decisions, and we believe some of those may involve USCIS errors. For those clients, we can evaluate whether to challenge the negative determination through litigation or wait for a final decision on the T visa application.

To our clients: We appreciate your patience!

Our team has received an extraordinary number of notifications in a very short time. We are reviewing them carefully and will be contacting affected clients to discuss their results and next steps.

We are incredibly grateful for your trust, patience, and support.

This is why litigation matters. Sometimes, challenging an unlawful government policy in federal court is necessary to bring about meaningful change. And sometimes, one lawsuit can help open doors even for people who were never part of the original case.

We are proud to have been part of this important effort and grateful to Jesse Bless for his leadership.

¡NOTICIAS IMPORTANTES!

t visa win, 34 months, no RFE.

10/09/2026

Attorney, Taiyyaba Qureshi, at Helen Tarokic Law PLLC:
For me, the hardest part after filing a client's T visa case is the WAITING for USCIS to take action on the case. When I first started at Helen Tarokic Law in 2023, the estimate was that a T visa applicant could expect to wait about 18 months for a final decision on the case.

In about February 2024, we got our first "Bona Fide Determination" letter for a T visa applicant whose application was filed in June 2023. This felt like a signal that we would start seeing those times steadily increase. Indeed, today, USCIS is estimating that it will make a decision on 80% of T applications in 34 months (you can keep track here: [https://egov.uscis.gov/processing-times](https://egov.uscis.gov/processing-times)).

**So when can a client expect a Bona Fide Determination now?**

I had our annual consult yesterday with a T visa client who had filed with us in **March 2025**. I was able to tell her yesterday that she and her derivative had been granted a BFD just this week—so that makes it about **19 months**. (We were all excited! I needed one of our staff members to help me with Spanish translation for this consultation, but I definitely understood “¡Gracias a Dios! ¡Estoy muy feliz!” all by myself 😊)

Generally, over the past few months, we’ve seen that BFDs are being granted at about **17 to 19 months without a Mandamus**. However, we have had clients waiting much longer without a BFD, inexplicably. And, based on the patterns of increasing timelines, I would not be surprised if the BFD timeline continues to increase as well.

For these “Did you forget about this one?” cases, and for clients who are interested in trying to push USCIS to adjudicate their applications faster, we are still actively using **Mandamus** as a tool to push for their stability. Clients in one recent Mandamus group (Mandamus can be filed individually or in a group) received their BFDs as part of a Mandamus-initiated settlement in September 2026 after waiting **12 and 15 months**. Clients in another Mandamus group received BFD answers over the course of July, August, and September after waiting between **13 and 24 months from filing**.

Immigration advocates around the country are trying to develop strategies on how to challenge a Bona Fide Determination denial. We’ve had a few of those in our office as well, and our tools have so far been to make a FOIA request for adjudicators’ notes, as well as to try a litigation strategy.

Jesse Bless and Helen are teaching “T Visa Litigation & Federal Challenges” today—and if you miss this one, keep an eye out on Eventbrite for more opportunities to pick Helen’s and Jesse’s brains on Mandamus and other litigation support for immigration applications.
