Divorce under Algerian law

Divorce happens! In this post we will talk about Algerian divorce regulation and complications we go through.
Many algeriens belive that when a divorce application is submitted the court will determine the responssability of each judicial part, the truth is the judge will focus only on who request the end of marital relationship. it's the only thing that will determine the court decision, this is why we will talk about the different kind of divorce cases by asking the question: who request the divorce?

Let’s start with the easiest case, If a separation agreement exists between both spouses , the judge will attest this willingness in a judgement and terminate the marriage relationship under the conditions in the separation agreement.
The most common case is when one of spouses requests the divorce without the consent of the other spouse, in this case the court will pronounce the divorce decree and condemn the plaintiff to compensate the defendant. this compensation will be symbolic and not calculated according to the damage suffered.
There is an exception to the Algerian regulation that gives the right to the wife when the husband failed to his obligations, she can submit a divorce complaint and in this case the defendant (husband) needs to compensate her for the damages . the law determine 7 reasons for which the wife can submit the complaint, some of those reasons the violence or the persistent disagreement.

Complications
As we mentioned , Algerian expatriates can face some difficulties when divorcing , for example they need to validate by an Algerian court, any foreign judicial or administrative decision to enforce it or use it as a document in Algeria.
Child support jurisdiction competence are complicated cases, some Algerians can be condemned to pay child support in both countries because of the difficulty proofing the child residency .

One of the prevalent legal cases that unfortunately can happen to Algerians living abroad is the foreign judgment recognition and enforcement.
Action en exéquaturs, the French designation of judgment recognition rendered in foreign jurisdiction (validation process).
Before locally enforcing a foreign decision, a court judgments or any order from a foreign authority, many countries request a judicial validation.
The goal is to verify if the foreign decision respect the Local regulations. In Algeria, most of the cases are related to family law.
For example, in a Massachusetts divorce case, which was pronounced by the Boston family court between two Algerians living in America. Both parties will not be able to register their divorce and update all personal documents in Algeria unless they obtain a validation judgment from an Algerian court.
In this case, the foreign decision is the divorce judgment and the personal documents update is the enforcement of the judgment.
Many cases can appear related to international business law or more specialized like litigations between foreign authorities.
In all cases, the court will pronounce the decision to accept the petition and validate the foreign judgment or denied the petition but should provide a legal reason for its decision.
Like all the judicial decisions in Algeria, the appeal right is guaranteed.
