Today the US Supreme Court handed down its decision in Peter v. Nantkwest, striking down a USPTO policy of automatically demanding repayment of its legal bills. The decision is based primarily upon the "American Rule" with regards to attorneys fees: each litigant pays for their own fees unless there is an explicit fee-shifting provision provided by statute (or in the general civil litigation arena if there is a contract provision between the parties that allows a prevailing party to recover attorneys fees).
