I've had several clients over the years who were the children of a parent who was separated but not divorced. It almost never ends well.

Typically, the parent did no estate planning and had no beneficiary designation on their accounts. So half of everything goes to someone they (presumably) wouldn't want it to go to. At best, it means the child has to make contact with the surviving spouse, someone they almost never want to have contact with, and ask them to waive their half.

Long-term separations are messy things, and it can be very difficult to get a party who doesn't want to get divorced to actually sign the paperwork. But having a finalized divorce decree and estate planning in place makes things so much easier on your children.

A client experienced his first moment of happiness recently after his father pass away, and was still carrying the guilt a week later.

Grief takes many different shapes, often times within the same person. It can feel like guilt, or anger, or depression, or numbness. It can keep you up at night, or make you sleep 16 hours a day. It can make you feel like you're a bad parent, or bad child, or bad spouse if you stop thinking about them or experience happiness without them.

It is also during that time you have to begin the process of transferring assets, planning funerals, talking to tax and 401k advisors. It can feel (quite often is) overwhelming.

But having a clear plan of what needs to happen can help, because then you're not juggling administrative hoops AND grief. It won't take the pain away, but it will at least allow them the space they need to experience it.
