A humorous post to let everyone know that for the foreseeable future, I will be unable to take on any new clients OTHER THAN estate plans, uncontested probate matters and transactional work. I have accepted an appointment as Supervisor of Hamburg Township, which is a full-time job, leaving me free only on Fridays to run my law practice. I am thus unable to commit to court appearances or any litigation matters.

But I'm still happily doing estate plans, so if you've been putting off getting that trust or doing powers of attorney, shoot me an email: [email protected].

If your license declares you to be an organ donor, you might want to get that changed. This incident that happened to Anthony Hoover has a lot of people rethinking their decision to be an organ donor.

If you're still wanting to be a donor, but are concerned about the way it will play out, you're better off:

1) Removing it from your driver's license; and
2) Executing a Medical Power of Attorney document, naming a Patient Advocate who will be able to assess the circumstances you are in and make the call on your behalf.

Nothing compares to having someone there who can exercise prudent judgment for you when you can't do it yourself.

Anthony Thomas “TJ” Hoover woke up before his organs were about to be donated after his family was told he was brain dead, an organ preservationist said.

Apparently August is "Make a Will Month". If I'd only found out about this in July, I might have been able to get some marketing out of it and drum up some business.

Anyway, if you haven't yet made a will, the Powers That Be have determined that this is the month to do it. Gimme a call: 810-772-1897 to schedule an estate planning consultation.

My son-in-law prompted me to read this book. An excellent read with good reminders for us all.

From a reviewer: "As a specialist in both medical ethics and the treatment of older patients, Dr. Lydia Dugdale knows a great deal about the end of life. Far too many of us die poorly, she argues. Our culture has overly medicalized death: dying is often institutional and sterile, prolonged by unnecessary resuscitations and other intrusive interventions. We are not going gently into that good night—our reliance on modern medicine can actually prolong suffering and strip us of our dignity. Yet our lives do not have to end this way."

My office practices Focused Protection.

“We know that vulnerability to death from COVID-19 is more than a thousand-fold higher in the old and infirm than the young. Indeed, for children, COVID-19 is less dangerous than many other harms, including influenza.

As immunity builds in the population, the risk of infection to all – including the vulnerable – falls. We know that all populations will eventually reach herd immunity – i.e. the point at which the rate of new infections is stable – and that this can be assisted by (but is not dependent upon) a vaccine. Our goal should therefore be to minimize mortality and social harm until we reach herd immunity.
The most compassionate approach that balances the risks and benefits of reaching herd immunity, is to allow those who are at minimal risk of death to live their lives normally to build up immunity to the virus through natural infection, while better protecting those who are at highest risk. We call this Focused Protection…

Those who are not vulnerable should immediately be allowed to resume life as normal. Simple hygiene measures, such as hand washing and staying home when sick should be practiced by everyone to reduce the herd immunity threshold. Schools and universities should be open for in-person teaching. Extracurricular activities, such as sports, should be resumed. Young low-risk adults should work normally, rather than from home. Restaurants and other businesses should open. Arts, music, sport and other cultural activities should resume. People who are more at risk may participate if they wish, while society as a whole enjoys the protection conferred upon the vulnerable by those who have built up herd immunity.”

In my office, masks and social distancing measures are optional. We will be happy to implement them upon your request.

I wasn't going to say anything because it seemed just a little like ambulance chasing, but I've now received a number of inquiries from people regarding Estate Planning During the Time of Coronavirus, so I thought it prudent to just put the information here and people can do with it what they will.

Yes, I'm still open and taking clients, and we can do all but the final signing of documents remotely. So if anyone is interested in getting their estate plan taken care of, now (well, after Easter) is the best time to do it, because I've got the time! Please email me at [email protected] and I will send you information about how to proceed.

And of course, this applies to other situations as well, not just estate planning. I am happy to schedule a phone or video conference to discuss your needs.

Stay safe, everyone.

This is the same sound advice that professionals have been offering for years. It doesn't change because we're facing a health crisis. If anything, the crisis provides some clarity and perhaps some motivation for getting your affairs in order.

And hey, unless you're a health care professional or newly-homeschooling parent, you've probably got a little more free time to start working on these things.

As the global coronavirus pandemic continues to unfold, there are some non-investing matters we should consider in order to protect our families and financial well-being. Here are ten ideas to think about...

A good article to get you thinking along the right lines of getting your stuff together for the sake of the loved ones you leave behind.

One of the essential things to do before you die is to prepare a folder.

Now that summer's winding down, I encourage you to get your will/estate in order.
