New York is considering Senate Bill S9269, which would enhance protections for the usage of an individual’s health data outside of public and private health care providers. It would mandate clear and conspicuous notice of what data is being collected and how it will be used, the explicit consent of each individual, and that health data that is bought or sold is fully anonymized. Our Health Care Litigation team can help companies that collect “regulated health information” (RHI) not covered by HIPAA protect themselves from liability in these matters.

On April 24, 2024, the DOJ issued a Final Rule under Title II of the Americans with Disabilities Act (ADA) requiring all government websites and apps at the state and local level be made fully accessible. For states and local governments with populations over 50,000, the compliance deadline passed on April 24th. Municipalities with populations under 50,000 have until April 24, 2027 to audit and remediate their websites. Co-Managing Partner Robert Braumuller and our Municipal Law Group are already working hand-in-hand with municipalities to ensure compliance with federal and state accessibility statutes.
