You may be asked to perform field sobriety tests or submit to a breathalyzer, so you should understand your rights before complying with any requests. Once arrested, your most important next step is to contact an experienced DUI attorney as soon as possible. When a driver is pulled over on suspicion of drunk or impaired driving, the officer will observe their behavior, ask questions, and administer Standardized Field Sobriety Tests to determine whether there is enough evidence to make an arrest. From there, the suspect is taken to the station for chemical testing, which can include a breath, blood, or urine test. In cases where drug impairment is suspected, a specially trained Drug Recognition Expert (DRE) may be called in to perform a detailed evaluation. Once the investigation is complete, the suspect is booked into the county jail, fingerprinted, and typically brought before a court within 24 hours of being detained.

Summer is full of outdoor activities and celebrations, and while enjoying a few drinks at a public gathering is not illegal in Colorado, things can take a legal turn if your behavior crosses the line. Disorderly conduct, harassment, or other offenses committed while intoxicated in public can open the door to additional charges, including a DUI. If you’re planning on attending any public event that involves alcohol, remember to conduct yourself in an appropriate way and find a safe ride home.

If you’re under the age of 21 and get caught driving under the influence, you’ll likely face charges that will follow you into adulthood. For underage individuals, your BAC only needs to be .02% to be charged with UDD, which is much lower than the .08% limit for adults. The consequences are significant, and retaining expert legal counsel should be a priority.

Many individuals who are convicted of DUI find themselves having to install an ignition interlock device as part of their sentencing. These devices prohibit the driver from starting their vehicle if alcohol is detected on their breath. To ensure the driver does not consume alcohol while operating the vehicle, the equipment requires repeated testing during the drive. Whether or not you’ll be required to have one of these devices, and how long you’ll be required to use one, depends on your case.

What is an Ignition Interlock Device in Colorado? An ignition interlock device can help prevent you from receiving a DUI charge and keep you safe while driving. Find out when you are required to have one.
