People are usually surprised to learn that 401(k)s, pensions, and any retirement accounts earned during the marriage are considered marital property in Ohio. They are subject to division just like the marital residence or bank accounts. The name on the retirement matter does not matter if it was earned during the marriage. Contributions made before the marriage are considered separate property and remain with the original owner.

The Ohio Supreme Court recently ruled on the specific circumstances of a custody case and held that a juvenile court must find a parent unsuitable before granting legal custody to non-parents. In re A.S., 2026-Ohio-3906 (Ohio 2026). In the underlying case, Mother had previously lost custody of her daughter due to substance abuse. At that time, the child was determined to be a dependent child and Mother was determined to be an unsuitable parent. Mother completed a treatment plan, regained custodial rights, and the court closed the case. A few years later, Paternal Grandparents sought legal custody citing Mother’s marriage to a s*x offender and the child’s poor attendance at school. Father had passed away. The juvenile court granted legal custody to Paternal Grandparents. The court inferred unsuitability from the prior case, but did not make a specific finding that Mother was an unsuitable parent. The Ohio Supreme Court held that the lower court ruling violated Mother’s fundamental liberty interest in the custody of her child. The Ohio Supreme Court reversed the custody decision and remanded the case for a determination of whether Mother is an unsuitable parent.
