The Supreme Court of Canada has recognized a new tort of intimate partner violence. This landmark decision in Ahluwalia v. Ahluwalia marks a vital step forward for survivors, as the Court now officially acknowledges coercive control as a distinct civil wrong.

This ruling means that behaviours like isolation, emotional manipulation, and financial abuse can directly form the basis of a civil lawsuit. Survivors no longer have to squeeze their experiences into older legal categories that focus only on single incidents of physical or psychological harm.

For a long time, intimate partner violence has been pushed into existing torts that focus on specific incidents—assault, battery, IIED—when a lot of people’s experience is actually about patterns of control that build over time. The Court is recognizing that the harm isn’t just what happens in those moments, but what that pattern does to someone’s autonomy and sense of self in the relationship.
