Get to know our West Des Moines Leadership Academy Class of 2022-2023! This week's feature is on Daniel Herting, Managing Partner at Herting Law.

Dan went into the legal field after a brief stint in political organizing. When asked what he likes most about working in law, he says it's that he gets to be a comfort for the people that need it the most (after some of their hardest days), and that it is humbling when people give you their trust in those moments.

As for what led him to WDMLA, Dan mentions that the program is a great way to work on professional development, and seek advancement. He's interested in being a better leader for his company, and a better person in his community.

Outside of work, Dan is a husband and father of two. His "unique talent" is storytelling, and he cites his favorite drink as boba and favorite movie as Emperor's New Groove. As for his favorite type of music, his wife is a pianist, so he gets to listen to live classical music every night (we're a bit jealous!).

Congrats Dan, we can't wait to see what you and the rest of your class accomplish this year in the program!

We have been quite lucky to have Nadia with us as our legal assistant for the past 15 months. Unfortunately for us, she just learned she A) has been accepted to Drake law school and B) is getting a full-ride scholarship. We are (of course) thrilled for her but sad we will be losing her.

As an interpreter serving in Afghanistan, Zalmay Niazy became a target of the Taliban, and applied for asylum in the U.S., where he'd settled among the Iowa cornfields. But when his application was turned down, the townspeople of Iowa Falls fought back.

Keith Herting will be on WHO at 4pm and KCCI at 6pm tonight talking about Zalmay Niazy.

Zalmay is a young man from Afghanistan who worked with US Forces as an interpreter in the fight against the Taliban. Because of his work supporting US Forces, he was a target for the Taliban. He survived multiple assassination attempts while still in Afghanistan and his uncle was murdered because of his work for the US.

We applied for asylum for Zalmay back in 2015. The process dragged on for years but this week we learned that his application was denied because of a claim that he “participated in terrorist activity.” When Zalmay was 9 years old, Taliban fighters came to his family home armed and demanded food. Zalmay’s mother told him to give those men food so he took them bread so they would not shoot his family or his home. By giving these men food, even though it was under the threat of death and at the age of 9, the government maintains that he provided material support for terrorists and is thus ineligible for asylum in the US.

At Herting Law we stand with our community’s teachers who we entrust to educate our children. The teachers in our community are expected to be more than just educators; they are charged with the task of also being allies, role models, and protectors to our children. During this uncertain and perilous time, the teachers who tirelessly serve our communities deserve support and protection from their community.

In recent weeks, school districts around Iowa have announced plans to reopen despite the ongoing public health crisis caused by the COVID-19 Pandemic. The decision to reopen schools to in-person teaching while the pandemic is still near peak levels through the state means that thousands of Iowans will be put in an impossible position where they are forced to put their own lives as well as those of their families in jeopardy in order to return to their jobs and their students.

As a gesture of our gratitude to those who educate our children; from July 15, 2020 until September 30, 2020 Herting Law is offering to draft a Living Will and/or a Medical Power of Attorney Designation for free to any Iowa public-school teacher, administrator, or support staff*. We hope this small gesture might help give you a small measure of comfort or peace of mind as you are returned to the classroom.

A living will is a legal document that lays out in advance what your decisions are about end-of-life medical treatment. It lays out the procedures or medications that you want to receive in order to prolong your life if you can’t talk with the doctors yourself. It also allows you to declare which medical procedures you do not want to receive in order to sustain your life in certain circumstances.

A medical power of attorney is a document that designates a specific person to make your health care decisions in situations where you can’t talk with the doctors yourself. The person you designate will have legal authority to work with your health providers to decide how you will be cared for when you do not have the ability to make those decisions for yourself.
