⏳ Why Has My Family Member Been Waiting Years for a Visa While Other Cases Move Faster?

When a family files an immigration petition, it is natural to wonder why some cases seem to move quickly while others may take years.

A long wait does not necessarily mean there is a problem with the case.

For many family-based immigration petitions, the waiting time can depend on factors such as:

✔️ The relationship between the petitioner and the family member
✔️ Whether the petitioner is a U.S. citizen or lawful permanent resident
✔️ The family preference category
✔️ The priority date
✔️ The country applicable for visa availability
✔️ The number of visas available in that category

📅 What is a priority date?

Generally, a priority date establishes a person's place in line in immigration categories that are subject to annual numerical limits.

Each month, the U.S. Department of State publishes the Visa Bulletin, which provides information about immigrant visa availability for different categories and countries.

This is why two people with approved family petitions may be at very different stages of the immigration process.

For example, there are different preference categories for adult children of U.S. citizens, certain relatives of permanent residents, married children of U.S. citizens, and siblings of adult U.S. citizens. Waiting times can vary significantly among these categories.

⚠️ An approved family petition does not necessarily mean that an immigrant visa is immediately available.
