🛑 TO BLOW OR NOT TO BLOW? 🛑

Part 3 of our Traffic Stop Series: The Breathalyzer Dilemma. 🚗💨

In Florida, “implied consent” means you already agreed to a breath test just by getting your driver’s license. If you refuse after a lawful arrest, you could lose your license for a full year—automatically.

But here is the catch:

*Refusing* keeps that breathalyzer number out of the state’s hands.
*Blowing* might provide the strongest evidence possible against you.

There is no “one size fits all” answer because every case is different. The biggest mistake you can make is a panic decision at 2:00 a.m..

Know your rights: You can always say, “I’d like to speak to my attorney”.

🚨 POLICE ENCOUNTER 101: What you say matters. What you DO matters even more.

👎 **BAD:** Arguing, getting confrontational, reaching around, or trying to “win” the interaction.

👍 **GOOD:** Stay calm. Keep your hands visible. Ask, “Am I free to leave?” Be respectful—and don’t volunteer information you don’t have to give.

⭐ **EXCELLENT:** Know your rights BEFORE the encounter happens. If you’re being detained or arrested, clearly invoke your right to remain silent and ask for an attorney.

Being respectful doesn’t mean giving up your rights.
Knowing your rights doesn’t mean being disrespectful.

Save this. You may need it when you least expect it. 👀
