What Auto Insurance do you need in Florida?

Personal Injury Protection

Personal injury protection or PIP is required for every policy holder in the State of Florida. If a policy holder is involved in an accident, PIP covers 80% of their medical costs and 60% of their lost wages. PIP is also referred to as “no-fault coverage” because the policy holder is entitled to benefits whether or not the car accident is their fault. In most cases, PIP also covers the policy holders spouse and the relatives living in your household. You are required to have at least $10,000 in PIP coverage. Some policies that go above the minimum amount of coverage are available as well.

Medical Payments (“Medpay”)

Medpay covers the other 20% of medical bills that are not covered by a policy holders PIP coverage. Medpay also covers medical bills greater than $10,000. If a policy holder chooses to purchase it as extra coverage. The amount of Medpay per holder varies according to their preference. My policy holders that also have health insurance find that Medpay in not necessary. It is important for policy holders to check with their health insurance agent before making the decision whether to purchase Medpay or not.
Property Damage
Property damage insurance or PD covers any damage that occurs to another person’s vehicle when a policy holder is at fault in an accident. This coverage is mandatory in the state of Florida. Levels of coverage can be seen to vary from company to company.

Collision

Collison insurance may not be auto insurance you need, but it is a form of insurance that many motorists want. Collision insurance covers damage that occurs to a policy holder’s vehicle that results from any accident. This form of insurance covers the cost of repair to your vehicle regardless of whose fault the accident was. Collision insurance is optional. It is common for the coverage to come with a $500 deductible.

Bodily Injury

Bodily injury insurance covers the pain and suffering sustained by another person that is involved in an accident with the policy holder when the accident is the policy holders fault. Bodily injury is optional in the state of Florida. Many policy holders purchase this type of insurance as a way to protect their assets in case they are ever at fault in a car accident. Different levels of this coverage are available.

Uninsured Motorist

Uninsured motorist insurance covers pain and suffering if you are hurt by the fault of another driver and that driver does not have enough coverage or any coverage at all to cover the extent of your injuries. In some cases, UM insurance may extend to the policy holders spouse, household relatives, or passengers in the car. It is common for policy holders to purchase UM coverage at the same level as their bodily injury insurance.

Does the patient need to seek treatment within 14 days of the motor vehicle accident to qualify for PIP coverage?

To qualify for PIP benefits, injured car accident victims must be treated within 14 days of the accident. If a patient does not qualify for PIP benefits because of the 14-day requirement, medical providers can certainly still provide treatment. Other possible sources of payment are health insurance, cash, and/or a letter of protection from the patient’s personal injury attorney.

HOW OUR PIP CLAIM PROCESS WORKS

1. PIP AUDIT BY A FLORIDA LITIGATORS ATTORNEY
Clients can make an appointment for a Florida Litigators attorney to visit their office to review their files or documents can easily be submitted electronically.

2. DEMAND LETTER
After reviewing our client’s files and determining which claims have been wrongfully reduced or denied by the insurance companies, Florida Litigators prepares demands and sends a written notice of intent to initiate litigation.

3. WAIT 30 DAYS
If the insurance company tenders payment, our client receives the benefits and Florida Litigators receives the statutory penalty, interest, and postage as attorney’s fees and costs.
Florida Litigators does not keep a percentage of the PIP benefits.

4. FILE LAWSUIT
If the insurance company continues to wrongfully file a claim, we file a lawsuit. When benefits are recovered from a lawsuit, the client is entitled to the medical benefits and interest, and the attorney’s fees and costs are paid by the insurance company.
