The Biden administration on Thursday extended the nationwide ban on evictions for a month to help millions of tenants unable to make rent payments during the coronavirus pandemic, but said this is the last time it plans to do so.

Dr. Rochelle Walensky, director of the Centers for Disease Control and Prevention, extended the evictions moratorium from June 30 until July 31. The CDC said “this is intended to be the final extension of the moratorium.”

The Consumer Financial Protection Bureau (CFPB) today issued an interim final rule in support of the Centers for Disease Control and Prevention (CDC)’s eviction moratorium. The CFPB’s rule requires debt collectors to provide written notice to tenants of their rights under the eviction moratorium and prohibits debt collectors from misrepresenting tenants’ eligibility for protection from eviction under the moratorium.

The Biden administration announced Tuesday that it would extend the foreclosure moratorium and mortgage forbearance through the end of June.

The actions would block home foreclosures and offer delayed mortgage payments until July, as well as offer six months of additional mortgage forbearance for those who enroll on or before June 30.

The eviction moratorium remains in effect through March but was not included in the actions announced Tuesday.

FHFA Extends Foreclosure and REO Eviction Moratoriums and COVID Forbearance Period

The Federal Housing Finance Agency (FHFA) announced that Fannie Mae and Freddie Mac (the Enterprises) are extending the moratoriums on single-family foreclosures and real estate owned (REO) evictions until March 31, 2021.

FHFA also announced that borrowers with a mortgage backed by Fannie Mae or Freddie Mac may be eligible for an additional forbearance extension of up to three months. Eligibility for the extension is limited to borrowers who are on a COVID-19 forbearance plan as of February 28, 2021, and other limits may apply. Further, COVID-19 Payment Deferral for borrowers with an Enterprise-backed mortgage can now cover up to 15 months of missed payments. COVID-19 Payment Deferral allows those borrowers to repay their missed payments at the time the home is sold, refinanced, or at mortgage maturity.

Breaking News

The House and Senate passed the Consolidated Appropriations Act, 2021 (the "Act") and now it is heading to the President for signature.

Section 532 of the Act extends the eviction moratorium as provided by the Centers for Disease Control and Prevention ("CDC"). The CDC extended the moratorium on evictions for non payment of rent due to COVID-19 hardships until 12/31/20. However, the newly passed act extends the CDC moratorium until 1/31/21.

Section 532 states as follows:

SEC. 502. EXTENSION OF EVICTION MORATORIUM.
The order issued by the Centers for Disease Control
and Prevention under section 361 of the Public Health
Service Act (42 U.S.C. 264), entitled ‘‘Temporary Halt
in Residential Evictions To Prevent the Further Spread
of COVID–19’’ (85 Fed. Reg. 55292 (September 4, 2020)
is extended through January 31, 2021, notwithstanding
the effective dates specified in such Order.

Please be aware that you can still be evicted for other reasons under your lease and you may have to prove to the Court that you have faced a hardship due to COVID-19. Further, upon expiration of the moratorium, you will be responsible for all unpaid rent, attorney's fees and costs.

The CDC issued guidance and a declaration form to be filled out to provide to your landlord or to the Courts in response to an eviction complaint.

My firm handles many cases involving sellers and buyers in regards to "AS IS" Residential Contract for Sale and Purchase of residential properties. I am seeing disputes from both sides.

Most of the disputes arise when the buyer has failed to close by the date agreed upon in the contract or in addendums extending the closing date. Sellers and buyers should be more understanding and patient with one another during this difficult COVID-19 era.

Make sure that your brokers are incorporating enough time to close in the contract so the transaction goes smoothly. For example, having a COVID-19 clause, which allows both sides more time due to unexpected delays caused because of the obstacles the COVID-19 era. Both sides put in time, effort and money to either sell or buy a house.
