Donnelly Phillips is happy to announce that our client, Matthew O'Banner, has been acquitted of murder and assault in the first degree.

In May of 2021, three men—two known as having violent reputations and at least one with alleged gang ties— arrived at his home, intending on attacking him. They came simply because Matthew told one of them to stop disrespecting his girlfriend. Matthew attempted to deescalate the situation after they arrived, but when a friend of his showed up for their regular Sunday-morning visit, the three men attacked his friend, stomping and kicking, one pulling his gun from his waistband.

Matthew had no choice but to defend his friend. The jury agreed.

We are grateful for the men and women who served on the jury. They evaluated the facts of the case and delivered justice yesterday. Today, Matthew has his life back.

Last week, Attorney Donnelly argued State v. Jones at the Connecticut Supreme Court. Mr. Jones was convicted in an 18-year-old cold case murder. The only evidence against him at trial was the testimony of a career violent criminal who received a reduced sentence and financial consideration for his testimony. Donnelly Phillips was retained to seek a new trial from Mr. Jones.

State and Federal Criminal Defense. Civil Litigation. Appeals.

Brandon Jones was convicted of a murder that occurred eighteen years ago. He was convicted even though there is no forensic evidence tying him to the crime. And of the thirty people present when the shooting occurred, no one identified Brandon. Years later, a man came forward, claiming Brandon was the perpetrator. He testified at trial that he saw Brandon with a gun in his hand. But this witness had his own violent past. He has been convicted several times for violent crimes involving guns and has spent most of his adult life in jail. The prosecutor, in consideration of this man's testimony, cut his current sentence from eight years to four years, wrote a letter to the Parole Board supporting his early release, and even agreed to remit a $5,000 fine.
It's hard to imagine that a person could be convicted based on these facts, that someone years later can come along and say you did it, but that's what happened to Brandon. He asked us to appeal his conviction, and after reviewing the transcript, we found some solid grounds that could earn him a new trial. It's odd that the legal system (courts, law firms, etc.) are often way behind the times when it comes to adopting technology. This announcement means they won't be printing those bulky law books in CT anymore. Up next, hopefully: fax machines!
