At a hearing this morning in Polk County District Court, it was confirmed by the Attorney General’s office that Governor Reynolds and the State of Iowa believe that the Iowa Civil Rights Act does not apply to Governor Reynolds’ decisions to terminate officers of the state.

Put another way, they believe that Governor Reynolds could wake up one morning and decide she wants an all-white cabinet and then proceed to summarily fire all non-white officers. According to the State, those fired officers have zero legal recourse and cannot sue for wrongful termination. The Governor could make the same decision based solely on other grounds such as gender, religion, age, disability or sexual orientation and the terminated officers could do absolutely nothing about it.

The State’s lawyers told the court, on the record, that the only way to hold Governor Reynolds accountable is to vote her out of office.

TIMELINE: We filed a lawsuit against Officer Fong 11 days ago charging him w/ hog-tying & nearly suffocating a man having a seizure. 6 days later, The Des Moines Register broke a story about the lawsuit which sparked outcry from the community who rightfully demanded to know why Officer Fong was still leading the de-escalation unit w/ the Des Moines PD. Just yesterday, the City announced that it will be abolishing the entire de-escalation program & Officer Fong’s role as a trainer. A third-party nonprofit will now be stepping in to handle that very important training. Officer Fong previously cost the City of Des Moines $800,000.00 for a use of force violation in 2018 when he beat, pepper sprayed, & dropped a handcuffed man on his face. The timing of our new lawsuit & the termination of the DM PD's de-escalation program is no coincidence. This is what demanding accountability looks like. Enough is enough.
