Acting Secretary of Homeland Security Chad F. Wolf announced that in response to the Supreme Court’s decision, the Department of Homeland Security will take action to thoughtfully consider the future of the DACA policy, including whether to fully rescind the program.

WHAT DID THE COURT DECIDE?

The Court ruled in favor of the DACA program, rejecting the Trump administration’s 2017 attempt to terminate the program. This decision restores the program completely, and both initial and renewal applications should be accepted by USCIS.

WHAT DOES THIS MEAN FOR THE COMMUNITY?

Current DACA recipients continue to be protected from deportation and eligible for benefits under the DACA program, like work authorization.

Eligible DACA recipients can continue to apply to renew their DACA for two more years.

Eligible individuals who never had DACA should be able to apply at this time.

All eligible individuals should consult with a legal service provider for information about applying for DACA for the first time, renewing their existing DACA, and/or getting screened for eligibility for other, more permanent immigration options.

It is possible Advance Parole may again allow DACA recipients to travel outside the United States and return. However, details of this possibility are still unclear, and the potential impact of the COVID-19 pandemic may limit the ability to travel. Check with a legal service provider for more information.

¡Ayer la Suprema Corte de los Estados Unidos decidió que va a consolidar y decidir varios casos sobre el programa de DACA!

Por ahora no hay cambios, solo sigue en pie la posibilidad de renovar el permiso de trabajo, pero esperemos tener una decisión positiva para la comunidad inmigrante; la decisión se espera posiblemente para la primera mitad del 2020.

Supreme Court of the United States will hear consolidated cases challenging the rescission of the DACA program!

For now, people may continue applying to renew their work permits. The Court is expected to give its decision sometime in the first half of 2020.

Si estas, o has estado, en las fuerzas armadas de los Estados Unidos, o la reservas, puedes explorar la posibilidad de arreglar el estado migratorio de tu pareja o tus padres.

Also, people with TPS, I strongly recommend that you apply for advance parole so that you can travel outside the US and return to this country with a legal entry. This will increase your chances of obtaining permanent residence in the future.
