• Do I need a trademark for my business? ⠀
• At what point should I consider it? ⠀

Great questions! There are a few factors. First, assuming that what you are looking to trademark is unique and not confusingly similar to intellectual property of another company in the same class of trade (i.e. industry), you have inherent trademark rights in your intellectual property. ⠀
⠀
So, if you have inherent rights, why would someone register their trademark? Registering your trademark puts the world on notice of your ownership of that intellectual property and creates a presumption in your favor in the event of a claim or lawsuit. So, essentially, the more you value your intellectual property rights and branding, the more you will want to trademark it. If you would care if another company started using the name, logo, etc., you should trademark it. ⠀

But let's take it back a step. How would you know that your trademark is uniquely yours and not confusingly similar to another's? You need to do extensive research, and this is often something we guide you through or can help with. You may be investing a lot in a name, logo, branding, graphic design, a website, developing brand awareness, and more. So, you want to make sure that when you're making those investments you actually have the right to use the name, slogan, etc. It would be a significant setback (and just honestly sucks when you love your branding) to have to rebrand. ⠀

There are filing fees and legal costs for filing a trademark, and it takes a few months for the US Patent and Trademark Office to review the filing and for any supplemental materials to be submitted. Let us know if this is something you'd like to discuss further! ⠀

The feeling I feel after I knock out a ton of legal work feels SO GOOD! Many people know I also own and am writing a book, so some people may thing that the legal part of what I do is boring. However, I love it. It fuels me, and it feels good being good at what I do and accomplishing so much for my clients. My clients are my favorite part of my job. ⠀⠀
⠀⠀
With that said, it's still dense work and sometimes hard to focus on. Here are a few of my productivity tips: ⠀⠀
⠀⠀
- turn the phone off or put it on the other side of the room⠀⠀
- work in bursts, such as a pomodoro 25 minute work, 5 minute rest cyle with a 15 minute break every hour (I like this on smaller tasks) or 90 minute chunks with 15-20 minute breaks in between⠀⠀
- turn each task into a time slot in your calendar ⠀⠀
- give yourself space in your schedule between meetings and tasks for breaths, pauses, regroups and in case anything runs over⠀⠀
- work from a space that inspires you like your couch with pups. outside or ⠀⠀
- work in comfy clothes! ⠀⠀

Great question, and honestly one I'd be asking too if I were in your shoes. So, fun fact: I became a lawyer so that I could be the best entrepreneur I could be. Crazy, right? All the years of crying through law school, endless hours studying, years of working in Big Law and all the harassment that entailed... all to be a better entrepreneur. ⠀

So, why would I do all that if I could get a template online? Because when you work with contracts, you have to know the implications of every sentence. It's kind of like going to a hair dresser who's spent years learning vs giving yourself a DIY COVID cut (we've been there). It could work, or it could be a big mess. The more complicated the cut, the bigger the risk. Same with legal, it could work, but it could also cost you more in the long run than if you had worked with a lawyer from the start (and sadly, we've seen this happen so many times). ⠀
⠀
The good news is, we're coming out with our own templates + courses, so not only do you have a template that we stand behind but you'll also have SO MUCH information explaining the in's and out's of the contract so that you are educated and empowered to DIY it with our support.
