In today's legal news: Jones Day partner Eric Dreiband during his confirmation hearing as nominee to lead the DOJ's civil rights division, departed from his the decision his boss made not to distinguish between the players in the Charlottesville clashes, and said what needed to be said: “The bigotry and ideology of neo-Na**sm, Na**sm, white supremacy and the Ku Klux Klan are a disgrace to this country and should be eradicated from the United States,” Dreiband said. “And if I am confirmed, anyone who perpetrates crimes or other civil rights violations … should know and they should be on notice that, if I am confirmed, the Civil Rights Division is coming for them.”

In today's legal news: Don’t hold your breath (and we know you are) for a rockumentary about Lynyrd Skynyrd. A New York federal judge has enforced the terms of a consent decree borne of a "blood oath" undertaken 40 years ago by the band’s surviving members following a plane crash in 1977. As Andrew Denney reports, the upshot is that the band’s former drummer can never release a biopic about its final years. The film, which had been set to be called, you guessed it, "Free Bird" and, later "Street Survivors: The True Story of the Lynyrd Skynyrd Plane Crash," finished shooting earlier this year. The oath declared that no one would again play under the Lynyrd Skynyrd name. Moral of the story? Tuesday's Gone.

In today's legal news: A law firm associate spent nearly two weeks last December in Hawaii, getting married and honeymooning in the Pacific paradise. All the while, she knew she was short on hours. At the end of November, the then second-year associate with Faegre Baker Daniels in Denver was 368 hours shy of the firm’s annual 1,850-hour expectation for associates. Work had been slow in the Rocky Mountain outpost’s product liability practice, and wedding planning had taken its toll. A November meeting with her boss had failed to quell Cook’s fear that she would be fired if she missed the target.

This month, Cook and the Colorado Attorney Regulation Counsel agreed to a nine-month suspension from the practice of law for the now former Faegre Baker Daniels associate. In a stipulation with the disciplinary board, Cook admitted to inflating and fabricating time entries totaling nearly 140 hours, worth nearly $40,000.

Moral of the story? Big law firms put big pressure on young associates to bill hours and things like this will continue to happen. Hire small firms and solo practitioners who won't assign a 2d year lawyer to your case under pressure to bill.

In today's legal news: Turns out that Kraft’s “100% Grated Parmesan Cheese” label is ambiguous enough to thwart a class action claiming that consumers were duped into buying the stuff that they said contained wood pulp. A federal judge in Chicago found that, sure, “100% Grated Parmesan Cheese” could mean the product is 100 percent cheese and nothing else, but it could also mean that 100 percent of the cheese (wood pulp not included) is parmesan cheese, or that the parmesan cheese is 100 grated. Moral of the story - continue to not buy Kraft grated wood chips.

Being a Father starts with the core obligation of financially supporting your children. If you refuse to do that, then you shouldn't be permitted any custody of them whatsoever until you do. Unfortunately, the law hasn't gone that far yet, and there are guys out there who work under the table and purposely pay for nothing for their kids, who actually file for custody in Court and ask for custody trials trying to get full custody or increased time. Luckily, not too many deadbeat Dads have the level of shamelessness it takes to do that, but until they take all custody away from willful child support avoiders until they support their kids, these things will happen.

There are some things you can do to get the support your kids deserve though: Domestic Relations Sections (DRS) has the authority to issue court orders to secure assets, seize tax returns, freeze bank accounts, and take other measures in order to collect support arrearages by intercepting or seizing judgments or settlements like personal injury and workers’ compensation awards. The DRS also has the authority to intercept and attach annuity and life insurance income from a child support obligor, either as the owner or beneficiary of the income, when the obligor owes support arrearages.
