USCIS is *notorious* for delaying the timely review of applications. This is not an opinion. It's an objective fact. (E.g. the I-601A Applications for waivers that are taking 3+ YEARS 🙃). This "standard practice" included review and adjudication of simpler applications, such as work permit RENEWALS.

There were thousands of people who would timely file an application to renew their work permits (for which they had been vetted and screened already and that's why their initial work permit had been issued). They would then wait for over a year for USCIS to review their application and renew their permit. Meanwhile, their previous permit would expire causing chaos for the employed and the employers who were forced to suspend or fire critical employees thanks to USCIS delays. For that reason, USCIS announced automatic extensions for some categories starting in 2022. This was a way to resolve these gaps caused by USCIS delays.

USCIS has announced today that starting TOMORROW, automatic extensions will no longer be allowed. Even if they're the ones causing the delay. This is to "vet and screen" and "protect the public"...from people who were already previously vetted and screened 🙄 Further, let's also point out that an extension is NOT an approval. An extension just means you can continue working (temporarily) while USCIS drags their feet to review your application, which *could still be denied* if they determine you are no longer eligible for the benefit for some reason. An extension, therefore, does not get in the way of their "vetting and screening" efforts. But anyway...

In short, heads up to those of you in categories that were previously permitted automatic extensions. I DOUBT that USCIS will be adjudicating applications any faster than they have for the last few years, so I encourage you to apply for your renewals at least 6-9 months before expiration.

This does NOT affect people who applied for renewals and received an automatic temporary extension BEFORE today. Those extensions will remain valid.

The Department of Homeland Security has announced an interim final rule ending the practice of automatically extending employment authorization documents for aliens filing renewal applications in certain employment authorization categories.

UPDATE regarding the $1,000 fee for those receiving or entering the US on Advance Parole -

For those traveling with Advance Parole while in DACA status - expect to pay this fee either at the time the AP is approved, or at the time you return to the US (at the port of entry).

For those who have been issued Advance Parole/travel document based on a pending application for adjustment of status - the regulations are quite clear that this new fee does NOT apply to those with a pending adjustment application.

HOWEVER, there have been multiple reports of people traveling under this second category who are still being extorted by CBP officers at ports of entry b/c they either (1) don't know the regs; or (2) abuse their power to extort immigrants "just because."

For those who are traveling on Advance Parole with a pending adjustment application, we recommend carrying a copy of your I-485 receipt notice as well, as additional proof of your pending adjustment. And please report any abuses to your attorneys or community leaders if they occur.

USCIS announced today that they will require a $1,000 fee for certain people who are being granted parole, including Advance Parole. It is unclear whether this applies retroactively to cases that have been pending or only to new applications filed after today. It is also unclear on whether it applies to requests for military parole. It is, however, likely to apply to DACA recipients who request Advance Parole. This is on top of the $630 filing fee.

We are continuing to monitor any announcements and will share those when we have more information. For now, this is all the information available:

International Travel for PERMANENT RESIDENTS!!

Whewww we are getting a LOT of calls from all of our hundreds of permanent residents right now with summer vacations heating up. 🫠🫠 If you are a permanent resident and plan to travel internationally anytime soon, contact us ONLY if you meet one of the following criteria -

1. Your permanent resident card is expired or will expire in the next 6 months.

2. You have been outside the US for 6 months or more.

3. You have any criminal history or encounters with the police. This means something other than speeding tickets or parking tickets. "I paid it" does not remove it from a background check. An arrest will still show up on your record. You can call us and schedule an appointment to discuss whether your specific history is problematic or not.

4. You have been or are now in removal/deportation proceedings. If you've ever been in removal proceedings or have had contact with immigration officers at some point, same as above. Call to schedule an appointment and discuss further.

5. You had CONDITIONAL residence (2-yr card) at some point and never filed the I-751 to remove those conditions. Oops! This is a "problemita" that's about to be a "problemazo." Call us.

6. You're active on social media or college campuses regarding support (or disdain) of certain conflicting countries. Or just publicly have a political opinion. The US's "freedom of speech" feature appears to be malfunctioning at the moment, so...let's chat 🙃

If one of these applies to you, call and schedule an appointment to discuss further. We do not offer on-the-spot yes/no answers over the phone. If it was that simple, you would have googled it 😊 So out of respect for your specific circumstances, you MUST schedule an appointment for a proper evaluation.

If NONE of these six scenarios applies to you, you're fine. We are not aware of permanent residents being denied entry back into the US as a general practice and there is no "new law" that changes this. You can travel as normal.

Either way, please keep in mind that we don't do magic and can't predict the future 🙃 So there's no point in asking what's going to change tomorrow, or next week, or next month. Any information and advice we provide is based on the facts and realities as they exist right now. We will share changes as they become necessary and available. Meanwhile, stay well and stay safe!

For others, it may be greater. There's no "one size fits all."

Sí, sabemos que han sucedido MUCHAS cosas en la última semana. 🙃🫠 Como cualquier otra oficina de abogados, hemos recibido una gran cantidad de llamadas y correos electrónicos de clientes y no clientes que intentan averiguar qué pueden hacer. Debido a nuestra ya alta carga de trabajo y a los límites de recursos, no podemos responder a todas las consultas individuales. Estas son tres de las preguntas más comunes que recibimos.

1. “Tengo una solicitud pendiente. ¿Eso me protege?”
- No. Lo único que lo “protege” es si tiene un estatus migratorio que ya ha sido aprobado. Si su caso aún está pendiente, no hay garantía.
- Un recibo será prueba de que tiene un caso en proceso. Puede presentarlo a un oficial que lo arreste si lo desea. Sin embargo, esto NO garantiza la liberación. Será a discreción del oficial decidir si lo dejarán irse sin arresto/cargos o no. Debe comprender que una solicitud pendiente no garantiza la liberación ni la protección.

2. “No tengo una solicitud pendiente, pero si presento algo ahora, ¿me ayudará?”
- Lo mismo que lo anterior. Tener una solicitud pendiente no garantiza protección contra la detención.
- En segundo lugar, puede o no ser elegible para solicitar algo. No todos los indocumentados califican para un beneficio de inmigración. Es un GRAN error entre el público en general, especialmente entre los ciudadanos estadounidenses privilegiados, pensar que CUALQUIERA puede solicitar una tarjeta verde. NO FUNCIONA DE ESTA MANERA. Hable con un abogado de inmigración autorizado para averiguar si califica o no antes de presentar cualquier solicitud.

3. “Entonces, ¿qué debo hacer si ICE me arresta?”
- Si se presentan en su casa, NO está obligado a dejarlos entrar a su casa sin una orden judicial. Niegue la entrada. Exija una orden judicial.
- Si entran a la fuerza de todos modos, documente/registre todo.
- Si lo recogen en cualquier lugar (casa, trabajo, etc.), NO está obligado a hablarles ni a proporcionarles ningún tipo de información. Mantén la calma, no luches contra ellos y, si te detienen, llama a tu familia y avísale para que se pongan en contacto con un abogado.

Hello everyone,
Yes, we’re aware that there has been a LOT happening in the last week. 🙃🫠 And like every other attorney’s office, we have been flooded with calls and emails from clients and non-clients alike trying to figure out what to do. Given our already high caseload and limits on resources, we are not able to respond to every individual inquiry. Here are three of the most common questions we are receiving, though...

1. “I have a pending application. Does that protect me?”
- No. The only thing that “protects” you is if you have immigration status that has already been approved. If your case is still pending, there is no guarantee.
- A receipt will be proof that you have a case in progress. You can present that to an arresting officer if you wish. However, this does NOT guarantee release. It will be at an officer’s discretion to decide if they will let you leave without arrest/charge, or not. So please understand that a pending application does not guarantee release or protection.

2. “I don’t have a pending application, but if I file something now, will that help?”
- Same as above. Having a pending application does not guarantee protection from being detained.
- Second, you may or may not be eligible to apply for anything. Not everyone who is undocumented qualifies for an immigration benefit. It is a HUGE misconception among the general public – especially privileged US citizens – that ANYBODY can just apply for a green card. IT DOES NOT WORK THIS WAY. Speak with a licensed immigration attorney to find out if you qualify or not before you file any application.

3. “So what should I do if ICE arrests me?”
- If they show up at your house, you are NOT obligated to let them into your home without a warrant. Refuse entry. Demand a warrant.
- If they force their way in anyway, document/record everything.
- If you are picked up anywhere – home, work, etc – you are NOT obligated to speak or provide them with any kind of information. Keep quiet, remain calm, do not fight them, and if you’re taken into custody, call your family and let them know to contact an attorney.
