If you or someone you love has been the victim of a crime in the United States, you may qualify for a U Visa, even if you are undocumented. The U Visa was created to protect victims and encourage them to cooperate with law enforcement without fear of deportation.

Here are the basics:

☑ You must be a victim of a qualifying crime such as domestic violence, sexual assault, kidnapping, felonious assault, trafficking, stalking, and many others.

☑ You must have suffered substantial physical or mental abuse as a result of the crime.

☑ You must have information about the crime and be willing to help law enforcement investigate or prosecute it.

☑ The crime must have happened in the U.S. or violated U.S. law.

✅A path to a Green Card after three years in U status

If ICE contacts you, it’s important to stay calm and remember that you have rights, no matter your immigration status. Here are key steps to protect yourself:
🔹 Stay silent. You do not have to answer questions about your immigration status or where you were born.
🔹 Do not open the door unless ICE shows a judicial warrant signed by a judge NOT an administrative warrant.
🔹 Ask to see the warrant through a window or under the door.
🔹 Do not sign anything without speaking to an attorney.
🔹 Ask a family member to find you an immigration lawyer immediately. The first 24 hours after your detention are important to speak to an attorney.

Si ICE se pone en contacto con usted, es importante mantaner la calma y recordar que tiene derechos, independientemente de su estatus migratorio. Estos son los pasos clave para protegerse:

🔹Guarde silencio. No tiene la obligacion de responder preguntas sobre su estatus migratorio ni sobre su lugar de nacimiento.
🔹No abra la puerta a menos que ICE le muestre una orden judicial firmada por un juez ( no una orden administriva ).
🔹Solicite ver la orden a traves de una ventana o por debajo de la puerta. No firme ningun documento sin antes hablar con un abogado.
🔹Pida a aun familiar que le consiga un abogado de inmigracion imediato. Las 24 horas tras su detencion son cruciales para poder hablar con un abogado.

Estar preparado es importante. Mantenga los siguientes documentos esenciales reunidos en un lugar seguro y asegurese de que un familiar de confianza sepa donde se encuentran y pueda acceder a ellos en caso de que usted des detenido: ✔️ Pasaportes de todos los miembros de la familia
✔️ Certificados de nacimiento del no ciudadano y de todos los miembros de la familia
✔️ Permiso de trabajo
✔️ Tarjeta del Seguro Social
✔️ Documentos de visa o de la tarjeta de residencia (Green Card)
✔️ Formulario I-94
✔️ Recibos de trámites de inmigración
✔️ Cualquier documento judicial relacionado con contactos previos con la policía
✔️ Comprobante de domicilio
