Did you ever wonder what to do about the neighbor’s tree that drops acorns and leaves onto your property? What about if your neighbor’s tree actually causes physical harm to your house? What can you do about it? Can you just take an axe to the tree? Well the Supreme Judicial Court of Massachusetts just ruled that you have no cause of action if your neighbor’s healthy tree causes physical harm to your property. The SJC upheld the long-standing Massachusetts Rule that you can prune limbs that overhang your property and cut roots that “trespass” onto your property, but you cannot sue for property damage if the neighbor’s healthy tree causes physical harm to your house. In Shiel v. Rowell, Shiel sued her neighbor for damage to her roof that came from the Rowell’s sugar oak tree. Shiel urged the court to change from the Massachusetts Rule to the Hawaii Rule. In Hawaii, your neighbor could be liable for damages and be required to cut back offending branches. In upholding the rule of stare decisis, the SJC declined to fell judicial precedent (the Court’s pun, not mine) and ruled that the owner of the offending oak tree was not liable for damage to the neighbor’s roof.
