If you have been in a car wreck that was not your fault we recommend that you do not speak with the other driver's insurance adjuster until you have spoken with a private attorney. Many people do not realize the adjuster for the at-fault driver is trying to pay you as little as possible for your damages. They are literally not "on your side." In reality the adjuster hopes to deny your claim or pay as little as possible to increase corporate profits. In NC liability insurance companies have no duty to be fair to victims of car wrecks. Know your rights.

Car Wreck Action Items:
1. Don't move your vehicle
2. Take photos of everything: people, cuts\bruises, cars, skid marks (if you are unable send a friend to the scene)
3. If you make a voluntary statement to law enforcement, make it 100% truthful and complete.
4. Get contact information from every witness at scene.
5. Locate any businesses or DOT cameras that captured the wreck-ask them to save the footage (most erase after 30 days or sooner)
6. Do not make a statement to the other driver's insurance company until AFTER you talk to an experienced injury attorney. The adjuster's are skilled at saving their company money and they have no legal duty to be fair to you.
7. Follow all medical advice-otherwise the insurance lawyers will claim "it must not have been that bad...."

Real Estate Closing Fraud Alert: we have seen incredibly sophisticated and successful fraud schemes involving real estate closings. The fraudsters hack the lawyers, realtors, bankers, etc. emails and send fake closing wiring instructions to the unsuspecting buyer. The buyer unwittingly wires their money to the fraudster's overseas account. Before wiring any money you MUST personally call the intended recipient and verify their routing and bank account information. You need to initiate the phone call to the lawyer's known telephone number. Relying upon emails (which can look just like the real thing) and phone calls you receive (that look like local calls) could cost you your life savings.

The Melrose Law Scholarship asked graduating seniors to submit a video to show young people the dangers of driving under the influence. If we can keep prevent DWI accidents, we can all do our part to save lives.

Whether you are hiring a contractor, booking a wedding venue, or buying something expensive, the very best advice we can give you is to get your agreement in writing signed by the other party. When things don't turn out as expected the first thing we ask is whether the agreement is in writing. Breaches of written contracts are often resolved quickly. When it is a "handshake" deal, all bets are off who the jury will believe. If the other party refuses to put it in writing, walk away from the deal.

We handle legal malpractice cases and I am often surprised when the lawyers who are being investigated refuse or delay turning over their files to their former client. The NC Rules of Professional Conduct explicitly state the file is the personal property of the client, and refusal to deliver the file to the client will result in State Bar disciplinary action. Clients faced with a reluctant lawyer who is refusing to turn over their file should immediately get advice from an independent attorney.

Iryna's Law which now prohibits many pretrial releases of Defendants charged with violent crimes has resulted in overcrowding of local jails. The burden to pay for jail space has fallen on local government since these people are not in the state prison system. The primary funding mechanism for local jails and the impact of this law is property taxes and homeowners are the ones who are paying. WLOS article in comments.

We are seeing many more dog bite cases with these dogs having a prior history of aggression and viciousness. Failure by the owner to adequately secure and restrain a known vicious dog will result in civil liability including potential punitive damages.
