This afternoon, the Ellis County Commissioners Court unanimously approved a $250,000 mediated settlement agreement in the defamation and malicious prosecution lawsuit filed by Constable Mike Jones and his wife, Melva Jones. Congratulations Mike and Melva for this measure of vindication for all you had to endure.

Last week we wrote a post promoting the estate planning practice of my partner, Phillip Gilbert. His wife fell asleep reading it because it really was too long and wordy. We'll be more direct. Here goes . . .

Real estate attorney and Gus and Gilbert partner Phillip Gilbert is taking on the Ellis County Appraisal District for trying to force a Midlothian man out of his homestead by taxing it as commercial property even though it is zoned and occupied as a single family residential property. The Appraisal District's actions are in disregard of the Texas Constitution and the Texas Tax Code that mandate that a person's homestead can only be taxed as a residential homestead even if an Appraisal District thinks it has a higher value as commercial property. Stay tuned for further developments in this important property rights case.

We are happy to have had a role in defending landowner rights in Ellis County. Judge Jim Chapman denied summary judgment to the companies trying to force a high speed rail line through Ellis County.
