The Barth Firm | Traffic Law Update

As of February 26, 2026, New York has substantially escalated penalties within its DMV point system, resulting in numerous everyday infractions carrying more significant weight than drivers may anticipate.

Here's what's changed:

Speeding (1–10 mph over limit)
Now: 4 points (previously 3)

Speeding (11–20 mph over)
Now: 6 points (previously 4)

Speeding (21–30 mph over)
Now: 8 points (previously 6)

Speeding (31–40 mph over)
Now: 10 points (previously 😎

Speeding (40+ mph over)
11 points (unchanged)

Using a handheld device / texting while driving
Now: 6 points (previously 5)

Failure to yield right-of-way
Now: 4 points (previously 3)

Running a red light
Now: 4 points (previously 3)

Disobeying a traffic control device
Now: 3 points (previously 2)

Passing a stopped school bus
Now: 6 points (previously 5)

Unsafe lane change
Now: 4 points (previously 3)

Following too closely
Now: 5 points (previously 4)

Why this matters:
Just 11 points within 18 months can result in a license suspension. With these increases, it takes fewer violations and less severe ones to reach that threshold.

If you've received a ticket or have questions about your exposure under the new system, The Barth Firm is here to help.

Reach out anytime for guidance.

Contracts are more than just paperwork—they define:

• Your rights
• Your obligations
• What happens if something goes wrong

A quick review now can prevent a much bigger problem later.

If something feels unclear, it’s worth taking the time to get it reviewed.

It is our job to think about and counsel you on what will happen in the worst case scenario.
