Can a number decide who lives or dies?
In Hamm v. Smith, the Supreme Court had a chance to clarify how intellectual disability should be evaluated in death penalty cases—but instead dismissed it.

The result?
No clear national standard.
Just a continued divide between IQ scores and clinical evaluation.

👉 For legal and clinical professionals:
This is why defensible, comprehensive assessments matter.
Because in cases like this, the outcome is not theoretical—
it’s life or death.

Maryland’s highest court upheld fines against the state health department for delays in providing timely psychiatric care to criminal defendants deemed unfit for trial.

This is directly relevant to forensic psychiatry/psychology because it involves court-ordered mental health evaluations and treatment for defendants deemed incompetent to stand trial, highlighting legal accountability for delays in forensic psychiatric services.

The article explains that Jesse Deacon’s fatal police shooting stemmed from systemic failures—officers lacked mental-health training, had no clear plan or information, and responded to a psychiatric crisis in a way that escalated to lethal force, prompting calls for reform.

This case is highly relevant to forensic psychiatry and psychology because it highlights how failures in recognizing and managing a mental health crisis can lead to fatal outcomes, emphasizing the need for proper risk assessment, crisis de-escalation, and police training informed by psychiatric expertise, as well as the role of forensic professionals in evaluating decision-making, use of force, and systemic accountability in such incidents.

Georgia plans to build a $409 million, 300-bed forensic psychiatric hospital—its first in decades—marking a shift back toward institutional care amid ongoing challenges balancing community-based treatment mandates from the Olmstead v. L.C. and the need for secure mental health services.

This development is highly relevant to both forensic psychiatry and forensic psychology because it expands the infrastructure for competency evaluations, criminal responsibility assessments, and treatment of justice-involved individuals, while also highlighting the ongoing tension between legal mandates for community-based care under Olmstead v. L.C. and the practical need for secure forensic facilities, where both disciplines play central roles in evaluation, risk assessment, and expert testimony.
