School Justice Project

School Justice Project School Justice Project (SJP) is a nonprofit organization in DC that provides special education legal services to court-involved youth ages 17-22.

Despite having special education rights under federal law, currently or formerly incarcerated students rarely have access to the promised education or to legal counsel to assist with obtaining it. Without access to education or access to justice, older court-involved students with disabilities continue to be marginalized and experience the worst outcomes. Though complex, this problem is solvable.

It requires filling the data gap on older court-involved youth, focusing on post-incarceration, beyond the traditional idea of the “school-to-prison pipeline.” Instead, SJP focuses on disrupting the "deep end" of the school-to-prison pipeline that funnels older court-involved students with disabilities from the juvenile justice system directly into the criminal justice system.

Incarceration is counterproductive to a student’s educational progress. Studies have found that placement in a juvenile detention facility reduced the likelihood of a student graduating high school by 31%, and that any level of incarceration makes a student less than half as likely to graduate high school. ⭐ The Youth Rehabilitation Amendment Act (YRA) is a law that allows youth convicted of most charges under the YRA to have their convictions “set aside”. Setting aside a conviction means that though the conviction can still be used by courts in a limited number of situations, it would now be completely sealed from the public and you would not have to report the conviction to any employers when they ask about your criminal background. For students with extensive trauma histories, access to robust, individualized support is widely considered to enhance their sense of safety and belonging, improve learning experiences, and mitigate the myriad of ways trauma hurts learning. The right to special education doesn’t stop even if you are arrested. Students incarcerated at the DC Jail who had an Individualized Education Program (IEP) in the community have a right to attend high school at the jail and access special education until the end of the school year in which they turn 22.
