Recent draft Deferred Resignation agreements failed to comply with the Age Discrimination in Employment Act (ADEA) and the Older Workers Benefit Protection Act (OWBPA) by not providing adequate notice to age-protected employees. In response, on February 11, 2025, OPM issued new guidance to federal agencies to ensure compliance.
✔️ New Executive Order on Workforce Reductions
On the same day, the President issued an Executive Order directing federal agencies to significantly reduce their workforce—beginning with temporary employees, reemployed annuitants, and other designated categories. Agencies are now required to develop Reduction in Force (RIF) plans, which may impact federal employees’ decisions regarding Deferred Resignation Offers.
