On Thursday, March 5, 2026, Judge Christopher Cooper of the United States District Court for the District of Columbia denied, in its entirety, the United States Government’s Motion to Dismiss a class action lawsuit brought by multiple federal workers concerning the egregious breach of public servants’ names, addresses, Social Security numbers, and other personal, sensitive information by untrained and unauthorized associates of Elon Musk and his Department of Government Efficiency. Judge Cooper ruled that the case should move forward and ordered the Government to answer the complaint by early April. The Court methodically rejected the Government’s arguments that the Plaintiffs had not sufficiently alleged that they had standing to bring the lawsuit or suffered any harm. Instead, Judge Cooper ruled that the Plaintiffs sufficiently alleged they suffered actual damages by having to buy identity theft protection services to safeguard against possible fraud.
Judge Cooper noted that the law that the Plaintiffs brought suit under -- the Privacy Act -- was meant to protect the privacy of those identified in information systems maintained by federal agencies, and it guaranteed the defense of information provided to the Government. According to Judge Cooper, "Defendants allegedly robbed plaintiffs of that peace by disclosing the data to DOGE [.]"
