At more than 12 million pounds reported use per year, 1,3-D is the third most heavily applied pesticide in California agriculture, used as a pre-plant soil fumigant for berry crops along the Central Coast and for almonds, walnuts, sweet potatoes, and other crops in the San Joaquin Valley. 1,3-D is highly volatile, is classified as a Toxic Air Contaminant and a Prop. 65 carcinogen, and is banned in 34 countries. It is manufactured by Dow Chemical, an intervenor on the side of DPR in the case.

“We applaud the court’s ruling striking down DPR’s immoral and unjust draft regulation,” said Angel Garcia, co-director of the Lindsay-based Californians for Pesticide Reform. “The court has ruled that a draft rule that would have allowed farmworkers to work right next to the edge of treated fields while they are being fumigated was unlawful. We look forward to a new regulation that corrects the profound environmental injustice of failing to protect farmworkers from this highly hazardous and drift-prone chemical.”

“Pesticides can cause short-term adverse health effects, called acute effects, as well as chronic adverse effects that can occur months or years after exposure. Examples of acute health effects include stinging eyes, rashes, blisters, blindness, nausea, dizziness, diarrhea and death. Examples of known chronic effects are cancers, birth defects, reproductive harm, immunotoxicity, neurological and developmental toxicity, and disruption of the endocrine system.

Some people are more vulnerable than others to pesticide impacts. For example, infants and young children are known to be more susceptible than adults to the toxic effects of pesticides. Farm workers and pesticide applicators are also more vulnerable because they receive greater exposures.”

Global polluter 3M has engaged in decades of deception, knowing its PFAS products were toxic but hiding that information from the public. It's why babies in the womb are born pre-polluted with toxic PFAS, and why PFAS exposure is a problem throughout the U.S.

EW estimates there may be more than 40,000 industrial polluters of PFAS in the U.S. and more than 200 million Americans could be drinking water contaminated with PFAS. Over the past few years, there have been many high-profile lawsuits filed against pesticide manufacturers by people who developed a serious illness as a result of pesticide exposure. The first of these major lawsuits involved the pesticide glyphosate which is the active ingredient in Roundup, one of the most commonly used pesticides in the United States. Ultimately, thousands of plaintiffs filed suit, claiming that exposure to glyphosate caused them to develop non-Hodgkin’s lymphoma. Other pesticides have been the topic of similar lawsuits. Plaintiffs filed suit against the manufacturers of chlorpyrifos, alleging that exposure to the pesticide had resulted in neurological injuries. Most recently, plaintiffs have been filing claims against the manufacturers of paraquat, linking it to Parkinson’s disease.
