Can I share my latest example of how much insurance companies suck? My client was crossing the street in a crosswalk with a walk signal. A driver turned left and hit her. It was her first week of retirement! Brain injury. Broken arm. Missing teeth. The driver’s insurance company said the driver had the right of way - but the intersection has no arrow! And you ALWAYS yield to pedestrians. But they denied liability. So I went out there with my iPhone and recorded a video of the light cycle to show the adjuster his theory of the case was impossible. Denied again. Asked for a supervisor. Nada. So my next move was a letter directly to the driver. I told them they did the right thing and had insurance to cover injuries caused by accidents. I said my client wasn’t angry and knew it was just an accident. And I told them I was really sorry but I was going to sue them for way more than the insurance coverage they had because their insurance company refused to honor the insurance contract they paid for. I asked them to call the company, demand that it pay the claim, and suggested that they hire their own lawyer to go after the insurance company for breach of contract. I gave them two weeks and included a draft lawsuit. What do you know? The insurance company paid my client. 🙂 I really was sorry. We shouldn’t have to sue people most of the time. I guess I should just be grateful for job security!

I had the rare opportunity to impress my boys today.

Geico: "Are you going to respond to our last offer?"
Me: No.

Geico: "Our offer is really fair, but in a sign of good faith, we will come up by $5,000."
Me: I'll tell my client but you should not expect a response.

Geico: "We're willing to work with you, but your refusal to negotiate isn't doing your client any favors."
Me: "Don't talk to ME about how I take care of people. I spent two hours yesterday in my client's back yard discussing their injuries. Your offer is garbage, and you can expect us not to respond. You can pay what we demanded or I will try this case."

Children: Run upstairs to report to Dave that "mom is yelling at someone at Geico."

Look at this picture and tell me I'm wrong. Geico can pound sand. (My client was badly hurt but is recovering.)

So interesting. As a lawyer-mom, I hate signing those broad, sweeping waivers every time my kids set foot in a building outside our home. In this case, a mom signed a waiver for her child's friend and Sky Zone tried to enforce it against the injured kiddo. No dice! The mom who signed the waiver wasn't legally authorized to waive away another child's rights.

A New Jersey state appeals court on Wednesday said a Sky Zone trampoline park cannot use an arbitration agreement signed by the mother of a boy's friend to keep his own mother from pursuing a lawsuit in court alleging the facility's negligence caused the child to fracture his leg.
