Living Will vs. Last Will & Testament — do you know the difference?

These two documents get mixed up all the time, but they serve completely different purposes:

📋 Living Will — takes effect while you’re alive. It outlines your medical care wishes if you’re ever unable to communicate them yourself (also called an “advance directive”).

📜 Last Will & Testament — takes effect after you pass away. It directs how your assets are distributed, names guardians for minor children, and appoints an executor to carry it all out.

The bottom line: one protects your voice in a medical crisis, the other protects your legacy after you’re gone. Most people need both.

The honest answer: It almost certainly does NOT solve your estate planning. ❌

While it skips the court process for that one account, it opens the door to some massive risks you might not see coming:

⚠️ The Hidden Pitfalls:
Loss of Control: Once they are a joint owner, they have full legal access to withdraw money right now without your permission.

Family Tension: If you have multiple children, leaving one on the account with the “understanding” they will share is a recipe for disaster. Legally, they don’t have to share a dime.

Their Problems Become Yours: If your child faces a lawsuit, debt collectors, or a divorce, the money in your account could be exposed to their claims.

It Overrides Your Will: Joint ownership trumps what your will says. Even if your will says “divide everything equally,” this account goes entirely to the co-owner.

💡 There is a better way!
If your main goal is just passing the money quickly without court drama, consider naming a Payable-on-Death (POD) beneficiary, or setting up a Living Trust. These tools keep you in complete control during your lifetime without exposing your hard-earned money to unnecessary risks.

True estate planning looks at your whole life—your family dynamics, your home, your healthcare wishes—not just one checking account.
