Sinapi Law recently obtained a significant ruling for a civil rights client in the United States District Court for the District of Rhode Island arising from an incident involving officers of the Providence Police Department.

In a rare decision, the Court granted summary judgment on liability for the plaintiff in a ยง 1983 civil rights case, holding that a police officerโ€™s use of force violated the Fourth Amendment and that qualified immunity does not apply.

"A North Smithfield police officer is suing the town, asking to be put back on the force after developing post-traumatic stress disorder on the job. Nicholas Tomasetti had been an officer for five years, including as one of the handlers for the department's therapy dog, when in May 2022 he responded to a su***de. He was later diagnosed with PTSD and received treatment, but a new lawsuit claims that when doctors cleared him to return to work, the department refused to reinstate him.

'Eight medical professionals, six selected by the police department, have examined him. All say he is ready, willing and capable of returning to work. Yet, the police department still won't return to work. Why? Classic mental health stereotype... . It sends the wrong message to police officers and anybody in employment who needs help for a mental health disability -- in this case, PTSD -- that they should not come forward, they should not seek help because they'll lose their livelihood, they'll be a marked as somebody who is incapable of performing the job and that sends the wrong message and that's the real tragedy in this case,' Sinapi said."
