WHAT IS TITLE INSURANCE AND WHY DO I NEED IT?

Most everyone has been there. Your purchase offer has been accepted. You have lined up financing. And then a lawyer tells you: “You need to pay for title insurance.” You wonder “Why?!”

First, you will hear about two types of title insurance policies - a lender’s policy and an owner’s policy. Both policies insure against possible problems or defects in the title to the property. As the name would suggest, a lender’s policy only insures your lender, whereas an owner’s policy only insures you - the property owner.

Second, just about any lender will require the borrower/owner to purchase a title-insurance policy. This expense is commonly associated with the loan. In Rhode Island, for example, the borrower pays the one-time policy premium. This policy is based on the dollar amount of the loan.

On the other hand, an owner’s policy is optional. This policy is based on the property purchase price/value. While not required, an owner’s policy can certainly be advisable under the circumstances. Each property-title warrants separate analysis. It is also helpful to understand the owner’s policy premium vis-a-vis the risks of going uninsured.

Lastly, as a buyer, your lawyer - and not necessarily the bank’s lawyer - can, and should, run through this pro/con list with you!

We are pleased to announce that Thomas Cappalli Jr. has joined the Firm as an Associate Attorney. A 2017 graduate of Roger Williams University School of Law, Tom recently passed both the Massachusetts and Rhode Island Bar Examinations. As a law student, Tom served as a law clerk for the State of Rhode Island Superior Court, and an extern at CVS Health Careers. Tom also successfully completed internships with the City of Cranston and Rhode Island Department of Business Regulation. Tom received his Bachelor of Arts in Business Law at Arizona State University, where he was a member of the Dean's List.
