A criminal record does not automatically disappear with time. In Rhode Island, certain records may qualify for expungement, but eligibility is determined by statute and must be approved by the court. ⚖

Expungement is a formal legal process that requires filing a petition and, in many cases, appearing before a judge. Approval depends on multiple factors, including:

1. The classification of the offense
2. Whether the matter was a first offense
3. Completion of all court ordered requirements
4. Satisfaction of the statutory waiting period
5. Absence of new or pending criminal charges

Filing prematurely or without proper documentation may result in denial. Each case must be carefully evaluated to determine whether expungement is legally available.

If granted, an expungement can seal eligible records from public access, which may impact employment opportunities, professional licensing, housing applications, and educational advancement. Eligibility is not universal. The only way to determine whether relief may be available is through a thorough legal review.

Did you know that in Rhode Island, you can be charged with a crime without ever being arrested?

Most people assume criminal charges only begin after an arrest, fingerprints, and a trip to the station. But Rhode Island handles many cases differently - and it often catches people off guard.

In certain situations, police don’t arrest you at the scene. Instead, they forward the incident to the Attorney General’s Office for review. If the AG decides there is enough evidence, charges can be officially filed without an arrest ever taking place.

What happens next? You may receive a summons in the mail or a court notice requiring you to appear. And while it may feel less serious than an arrest, a summons is still an active criminal charge - with the same potential consequences.

In a recent case victory, Attorney Brianna C. Repetto secured a full dismissal for a client charged with domestic assault and battery after a difficult and sensitive case.
