Happy Wednesday!

Isn’t amazing how fast a year can go by? Thanksgiving has just passed, Christmas is right around the corner, and a new year is fast approaching. In the fast paced world we all live in, this is the time of year to slow down and spend time with family and friends. It is a time to reconnect, talk about the past and look forward to the future.

But this might be one of the few times the entire family is together, so it is a good time to have some serious heart to heart conversations. You know the type of conversations we are talking about, those conversations that are often difficult to have. Take the time to talk with your family about how you are doing. Share with individuals whom you trust information on finances, heath care, and any other items that you believe are important.

Let them know where your papers are located, such as, Trust, Wills, Power of Attorney, HIPAA Authorization, Advanced Heath Care Directives, etc.

If you do not have these documents, talk with your family about the need for them. Ask their opinion and let them know how you would like to be cared for, who should make decisions for you, who you would like to get your most prized personal possessions, like the wedding ring, grandma’s chest, great-grandpa’s tools, etc.

The best way to avoid family conflict after you are gone is to put a plan in place and let everyone know there is a plan. Now is a great time to have those conversations.

Your trust does what?

Did you know that there is a special type of trust that can protect your assess if you need long-term care later on? Oh, by the way it is NOT a revocable living trust.

First, very often we have conversations with clients who tell us that their farm or house is already protected because they have it in a trust. Most of them are surprised to learn that if the trust is revocable, the trust provides no protection of their assets from the cost of long-term care.

Second, yes there is a trust that can and will protect your assets from the cost of long term care. It is an irrevocable trust, which is a special type of trust. There are several types of irrevocable trust…
- MAPT: Medicaid Assets Protection Trust
- VAPT: Veterans Asset Protection Trust
- Medicaid Family Protection Trust
- Special Needs Trust (certain types)

These types of trusts are great planning tools to use for long term planning or Medicaid planning but are not widely utilized because most people, including attorney’s do not understand how to use them properly.

Using an irrevocable trust can be an excellent way to help you and your family avoid needlessly spending all your money. They help avoid probate, which is always a good thing.

Did you know that Missouri is home to the longest river in North America! 😲 The river is very close to us too… The Missouri River! 🏞

The river derives from Montana, located at the base of the Rocky Mountains, and flows for approximately 2, 341 miles before it empties into the Mississippi River. The Missouri River and the Mississippi River combine to create the 4th longest river system in the world.

Happy Wednesday! I hope everyone is excited for some Wisdom!

So, Digital Information. Well what about it? 🤔

As we all know, technology is increasing rapidly and we are becoming more and more dependent on it. From Facebook all the way to financial instruments (such as bonds) are now being held electronically 💻📱

So what happens to a person’s Facebook account, the data stored in the cloud, email accounts, online banking accounts, etc? That all depends on what YOU do!

If you do not address your digital assets, your family members will not have access to the information, it can be very challenging if not impossible to access the information.

Many people have started to use their estate planning documents to let their loved ones know what to do with accounts such as Facebook and how to access them. With proper documentation, Facebook will allow to memorialize your account or permanently delete it. You can also name a contact person to look after your account.

Your documents are a great way to communicate where things are, how to access them, who should be in charge and who receives them.

Don’t leave your family scrambling, plan today!
