As minimum wage laws change and properly classifying employees is as important as ever, employers are required to stay abreast of new laws governing pay to employees. Add to that the California Equal Pay Act (EPA), the purpose of which is to prohibit employee compensation discrimination. As of January 1, 2026 employers now how more potential liability and additional damages under EPA for violations, according to Senate Bill 642.

Attention California employers! Effective February 1, 2026, the California Know Your Rights Act requires employers to provide a “Know Your Rights” notice to all employees. The notice must include information about a number of employee rights, including but not limited to workers’ compensation, protections against unfair immigration-related practices, the right to organize a union, constitutional rights when interacting with law enforcement, and rights related to designating an emergency contact to be notified if the employee is arrested or detained while at work. The good news is that employers do not need to prepare their own notice – a compliant notice is available in multiple languages at https://www.dir.ca.gov/wpnodb.html. Employers may provide the notice in hard copy or electronically. After the initial February 1, 2026, deadline, employers must distribute the notice once per year and also provide it to new employees upon hire.

We have embarked on a challenge at the firm: to volunteer at a non-profit as part of our community outreach. For our first volunteer day, the DLHA team enjoyed their behind-the-scenes tour and project at Joybound People and Pets, an animal placement organization, pairing families and pets, and doing other great work. Joybound is a fantastic organization, and we are so lucky to have them in our community!

Did you know that as of January 1, 2025, certain types of independent contractor agreements must be in writing in California? There has been an ongoing legal battle between the courts and opponents of the ABC test, used for identifying independent contractors, but the requirements for clarification and compliance has gotten stricter. The legal requirement for the types of contracts that must be in writing varies depending on the contractor, but the levels of complexity need close analysis if an employer, engaging contractors, wants to be on the right side of the law. The penalties and back pay for misclassification are steep so adherence to the requirements is critical and it’s best to consult counsel when engaging contractors of any kind.
