In California, when a person files for bankruptcy, he or she is entitled to exempt (retain) various assets. The exemptions under 703.140 are being increased effective April, 1, 2013 which allows someone filing for bankruptcy to retain more assets. This past July, the California Homeowner Bill of Rights was signed into law to become effective January 1, 2013. Among other protections, Dual track foreclosure is now banned. Lenders CANNOT proceed with the foreclosure process while a loan modification is pending. For more information see http://oag.ca.gov/hbor

On July 11, 2012, Governor Jerry Brown signed the California Homeowner Bill of Rights into law to bring fairness, accountability and transparency to the state’s mortgage and foreclosure process.
