⚠️ Homeowners: This Hidden Insurance Clause Can Cost You Your Coverage

Most people assume their insurance policy will be there when they need it most. But a little-known provision, called a Protective Safeguard Endorsement, can completely change that.

These endorsements require you to maintain certain safety measures (like alarms or sprinkler systems) as a condition of coverage. If they’re not working, or even temporarily offline, your claim could be denied.

Insurance carriers have a duty to investigate claims promptly, communicate honestly, and take clear coverage positions. Yet too often, policyholders are left waiting as insurers delay or refuse to act. That was at the heart of Maxus Metropolitan, LLC v. Travelers Property Casualty Company of America, where the insurer’s handling of a fire loss claim resulted in a jury verdict exceeding $27 million for breach of contract and vexatious refusal to pay.

📢 Important update for the property insurance industry in Connecticut: Conn. Gen. Stat. § 38a-726 has been clarified and updated, effective October 1, 2025.

Thanks to legislative efforts supported by Attorneys Jon Biller and Brianna Kastukevich Robert, this statutory update confirms that a public adjuster’s fee is calculated based on the amount paid by the insurer and may be collected once the insurer issues those settlement funds. This clarification resolves previous ambiguity around the term “actually received by the insured” and brings the statute in line with real-world claims practice ✅

This change helps reduce confusion when claim payments are routed through escrow accounts, mortgagees, or other payees.

⚖️ In addition to representing policyholders in litigation, Biller, Sachs & Robert continues to play an active role in shaping legislation and policy impacting the insurance industry.

⚖️Court Upholds Key Allegations in Policyholder’s Lawsuit Against State Farm! ⚖️

Attorneys Brianna Robert and Jon Biller of Biller, Sachs & Robert secured another important win for insurance policyholders in the recent Connecticut Superior Court decision, Roosevelt v. State Farm Fire and Casualty Company.

State Farm attempted to strike allegations of unfair practices (CUIPA/CUTPA) and bad faith brought by the insured - but the court disagreed. Judge Robin Wilson ruled that the plaintiffs, represented by Biller, Sachs & Robert, had alleged sufficient facts showing a broader pattern of misconduct, not just a one-time issue.

🔹 On their CUIPA/CUTPA Count: The court found multiple allegations of delays, low estimates, and unfair claim handling were enough to show a possible general business practice.
🔹 On their Bad Faith Count: The court held that allegations of knowingly undervaluing damages, misrepresenting coverage, and failing to investigate fairly were detailed enough to proceed.

This ruling underscores that insurers can and should be held accountable when they treat policyholders unfairly, affirming that multiple instances of improper conduct are sufficient to withstand an insurer’s attempt to dismiss a policyholder’s claim.
