Can you love your HOA President?

“Love” might be a strong word. That is, unless you’re my husband, who is required to love me despite the fact that I’m an HOA President.

Generally speaking, HOAs get a bad rap. Yes, sometimes that President may be the overbearing ogre of the neighborhood (but no, we will not call them “Karens” because we all know some amazing Karens, and that term is an absolute misnomer to them).

Good HOAs communicate, enforce, explain, and educate. A good HOA President sets the tone for the entire community through their actions and interactions.

I’ve seen all sides of this - as an attorney, as a homeowner, and as an HOA President.

I’m putting together something practical on how to actually do this role well (without creating a trail of chaos along the way) because while you may not love your HOA President … you shouldn’t dread hearing from them either.

Is a paper Will a thing of the past?

Not even close. But, as of January 1, 2026, attorneys can electronically store wills, and consider that copy valid (following a few key rules, of course). With everything else going digital, this seems appropriate.

Why is this useful?

1. Fewer “lost will” disasters - No original = not automatic chaos.

2. Easier probate process - A certified copy can be probated (and almost as simply as the original.)

3. Less litigation risk - This change shifts the presumption that a missing will means the will was revoked to “it could be valid”. Less missing originals = smoother administration (generally speaking).

4. More secure long-term storage - No more “Where did we put that thing?”�
5. Reduces fraud concerns - Attorney certification adds a layer of authenticity and accountability.
Good news: existing wills can be converted to electronic records without starting over.

The trade-off (and isn’t there always one?) is that once a will is stored electronically, revoking it becomes more formal, requiring a new level of legal structure rather than an informal physical destruction of the past.

This seems like a smart, modern move overall … if used wisely.

Legal problems don’t usually come from big, dramatic mistakes.

They come from small mismatches, assumptions, gaps, or things that weren’t clearly said.

The Fourth Circuit decided, in U.S. v. Tostado (argued by Sean Vitrano), that a sentencing issue turned on the discrepancy between what the judge said in court and what ultimately appeared in the written judgment.

That gap mattered enough to be appealed.

And for the Appellant to win.

Pay attention early to avoid bigger problems later.
