The EPA is actively going after companies that manufacture and sell emissions defeat devices and, based on my experience, I fully expect the agency is receiving copies of customer records from those commercial entities as well.

It’s worth noting that the EPA is authorized by statute to assess civil penalties of up to $45,268 per noncompliant vehicle or engine, $4,527 per tampering event or sale of defeat device, and $45,268 per day for reporting and recordkeeping violations. (42 U.S.C. § 7524; 40 C.F.R. § 19.4)

An E.P.A. investigation has found that the owners of more than half a million diesel pickup trucks have installed devices to defeat emissions controls and boost pollution.
