How does bail work ? In California, the bail bond system allows a defendant to be released from jail while awaiting trial by posting bail, which is a financial guarantee that they will appear in court. Here’s how it works:
1. Bail is Set
After an arrest, a judge sets a bail amount based on the severity of the crime, criminal history, and flight risk.
2. Paying Bail
The defendant has three options:
• Pay in Full: The defendant or a supporter can pay the full bail amount in cash to the court, which is refunded after all court appearances.
• Use a Bail Bond: If they can’t afford the full bail, they can work with a bail bondsman.
• Request Release on Own Recognizance: In some cases, a judge may release the defendant without bail based on their reliability.
3. Bail Bonds Process
• A bail bond agent (bondsman) posts bail for the defendant.
• The defendant (or someone on their behalf) pays the bondsman a non-refundable fee, usually 10% of the total bail amount.
• The bondsman may require collateral (e.g., property, car) to secure the bond.
• If the defendant appears in court, the bond is released, but the fee paid to the bondsman is not refunded.
• If the defendant skips court, the bondsman can hire a bounty hunter to find them, and the collateral may be seized.
