Military retirement pay isn’t automatically divided 50/50 in a Virginia divorce: and the details matter.

Under Virginia law, a court may treat the portion of military retired pay earned during the marriage as marital property. The division is generally based on the marital share and Virginia’s equitable-distribution rules, not simply on the total retirement benefit.

The Uniformed Services Former Spouses’ Protection Act (USFSPA) allows state courts to divide a service member’s disposable retired pay. However, it does not automatically award a former spouse a pension or guarantee direct payment from DFAS. The well-known “10/10 rule” generally concerns eligibility for direct DFAS payments when the marriage and military service overlapped for at least 10 years: it does not determine whether the pension is divisible.

A careful agreement or court order should also address:
• What counts as disposable retired pay
• The marital fraction and division formula
• Disability-pay waivers and other offsets
• Cost-of-living adjustments and retirement options

A parent shouldn’t be able to reduce child-support obligations simply by choosing to earn less: but income imputation is not automatic.

Under Va. Code § 20-108.2, Virginia child-support guidelines use gross monthly income. If a court finds that a parent is voluntarily unemployed or underemployed, it may calculate support using imputed income based on that parent’s earning capacity rather than actual pay.

The court may consider:
• Education and job training
• Work history and prior earnings
• The current job market
• Health limitations, caregiving responsibilities, or schooling
• Whether the reduced income reflects a legitimate reason or a bad-faith effort to lower support

Keep relevant records, including pay stubs, tax returns, employment records, job applications or offers, and medical or vocational documentation. If you have a legitimate reason for reduced income, maintain a written explanation and supporting evidence. Avoid exaggerating or misrepresenting your earning capacity.

Imputed income is different from actual income. It also is not the same as arrears or a support modification. Imputation is fact-specific and decided by the court.
