The last three consults I’ve done had one thing in common… they were operating their business without having obtained a business license. A business license is a vital piece to the formation of any business structure. In Virginia each city and county establish their own licensing requirements and most of them require a business license, even if you’re operating out of your home.

As the consequences of running a business without a license can be extensive and have a long-lasting impact on your company, it is crucial that you understand the risks of non-compliance. Failing to obtain or renew a business license can be a costly mistake, resulting in significant penalties.

Things to remember:

* If you’re conducting business within a city’s limits, check with your city government to determine its licensing requirements.

* If you’re in an unincorporated area, check with the county government.

* If you have an office in more than one city or county, you might need to get a license for each one.

A transfer-on-death (TOD) deed is a simple document that identifies the current owner(s) of the real estate and the beneficiaries who will inherit the property when the current owner(s) pass away. Using a TOD deed is a lot like using a payable-on-death (POD) designation for a bank account.

Here are some of the benefits of TOD deeds:

* Transfer-on-death deeds protect your property from probate.

* You can change your mind at any time and revoke the TOD deed.

* You still have complete ownership of the property and can decide to sell your property, give it away, or mortgage it during your lifetime.

* After your death, the beneficiaries can transfer the property title to themselves—there's no need to go through probate, saving the beneficiaries time and money.

Why not use a will? You can certainly use a will to leave your real estate to a loved one, but a will does not avoid probate. Generally, property you leave behind with a will enters probate proceedings. Probate costs money and time. So why not avoid it, especially when it comes to a significant asset like real estate, and for the peace of mind for your loved ones?

Did you know that beneficiary designations override the terms of a will!?! If you forget to update your beneficiary as your life changes, the person named will receive the money, even if that was not your intent. You should review the beneficiaries for all of your accounts every year or so to ensure the person you want to receive an asset receives that asset.
