The Indian Child Welfare Act (ICWA) has survived one of the biggest legal challenges in its history.

In Haaland v. Brackeen, the U.S. Supreme Court ruled 7–2 in favor of the federal law, rejecting major constitutional challenges and affirming Congress’s authority to protect Native children and Tribal Nations.

Passed in 1978, ICWA was created after decades of policies that separated large numbers of Native children from their families and communities. The law establishes guidelines that prioritize keeping Native children connected to their relatives, Tribal Nations, and cultural heritage whenever possible.

Tribal leaders across the country, including the Cherokee Nation, celebrated the ruling as a historic victory for Native families and Tribal sovereignty.

Today, ICWA remains one of the most significant federal laws protecting Indigenous children and preserving the bonds between Native families, communities, and future generations.

NOT GUILTY. After more than two years — Mr. Dustin Howard finally got to hear the words he had been fighting for: Not Guilty.

MAXEY LAW and Attorney Morgan Maxey were proud to stand beside Dustin in Wagoner County as a jury heard the evidence, held the State to its burden, and returned a verdict of Not Guilty after trial.

At MAXEY LAW, we do not take lightly the responsibility of standing between our clients and the power of the State. Every case matters. Every element matters. Every burden matters. And sometimes the most important thing a lawyer can do is make sure the jury sees the difference between an accusation and proof beyond a reasonable doubt.

This picture says a lot. Dustin is standing here with his wife, Kim Howard, after a long, difficult road that began on January 2, 2024 and did not end until May 5, 2026. For more than two years, Dustin had a criminal accusation hanging over his head. He kept fighting. His family kept standing with him. And when the evidence was finally tested in front of a jury, the result was clear.

Congratulations to Dustin and Kim Howard on this hard-fought victory. NOT GUILTY.

Law Day has Oklahoma roots.

The idea was born in Wewoka, where attorney Hicks Epton launched a public education program in 1951 called "Know Your Liberties, Know Your Courts Week" to help Americans better understand their legal rights. The program spread across the country, earned national recognition, and ultimately inspired President Eisenhower to formally establish Law Day in 1958.

This year marks the 50th anniversary of Ask A Lawyer, one of the longest-running public service traditions to grow from that original vision. Law Day 2026 is Friday, May 1.
